Justice for Marcus Allen Keppert

JUSTICE FOR MARCUS ALLEN KEPPERT

We, the undersigned, demand justice for Marcus Allen Keppert.

The following facts are true:

1) 15 year old Marcus, while a pedestrian, was killed by Drunk Driver George Xinos, on May 6, 2006;
2) Drunk Driver George Xinos had a blood alcohol level of more than THREE TIMES the legal limit when he killed Marcus;
3) Drunk Driver George Xinos was on probation for drunk driving when he killed Marcus;
4) Drunk Driver George Xinos had a suspended license and was speeding at the time of the accident and did not stop to provide aid to Marcus;
5) The police investigation into Marcus’s death was supervised by Lt. John Carr, husband of District Attorney Dolores Carr;
6) The District Attorney’s Office, headed up by District Attorney Dolores Carr and through her Deputy Charles Gillingham chose not to charge Drunk Driver George Xinos with Murder or Voluntary Manslaughter. Instead, Drunk Driver George Xinos was only charged with hit-and-run and driving under the influence;
7) Drunk Driver George Xinos has remained out of jail since he killed Marcus;
8) Almost one year after the horrific crime occurred and no progress in the criminal matter, Superior Court Judge David A. Cena made a plea bargain for Drunk Driver George Xinos and guaranteed Drunk Driver George Xinos would not be sent to state prison and be placed on probation, again;
9) The District Attorney’s Office, headed up by District Attorney Dolores Carr and through her deputy Charles Gillingham, failed to discuss and notify Marcus’s family of this outrageous plea bargain until after the deal was made.

Drunk Driver George Xinos should go to state prison. Drunk Driver George Xinos already failed on probation once when he killed Marcus. Why take any more chances with Drunk Driver George Xinos? Our families are not safe with anything less than a state prison sentence. How many more children and families must be put at risk?

The undersigned hereby demands the following:
(1) The plea bargain entered into on May 3, 2007 be reversed by Judge Cena;
(2) The District Attorney’s Office charge Drunk Driver George Xinos with Vehicular Manslaughter or Second Degree Murder;
(3) The case be set for a public trial by a jury and;
(4) Drunk Driver George Xinos be ultimately sentenced to state prison.
