Petition calling for the fair treatment of sexual assault victims during trial

To:  Indian High Commission

We are calling for the judges of the courts of India to maintain the decorum of their courtrooms and prevent the defence council in sexual assault cases from attacking the victim’s moral character in an attempt to suggest the attack was invited. This calls for the 2002 amendment of the Evidence Act to be upheld and implemented in Indian Courts. The amendment reads as follows:

“Amendment of section 146 - In section 146 of the Indian Evidence Act, 1872 (1 of 1872) (hereinafter referred to as the principal Act), after clause (3), the following proviso shall be inserted, namely:- Provided that in a prosecution for rape or attempt to commit rape, it shall not be permissible to put questions in the cross-examination of the prosecutrix as to her general immoral character."

We, the undersigned, are concerned citizens who urge the Indian High Commission and the Bar Associations of India to act now to ensure Section 146 of the Indian Evidence Act 1872, 2002 Amendment is enforced by judges in the courts of India.
