Back in and around 1997 or 1998 Boyd Stanley Huntington III was falsely accused of Several Crimes, Incest, Aggravated Indecent Liberties with A Child, and Rape.Against his sister,(Minor Child, Name not mentioned.) The real perpatrator Michael Johnson has never been caught nor has he spent anytime in the system.
His name was said in the Preliminary Hearing as the perpatrator, but nothing was ever done to go and apprehend him.
The date of the actual crime has never fully been determined, according to the Police and Court Records the date is documented as saying Between March 15th and November 15th 1997. They finally put on the later documents November 15th 1997 which happends to be Boyd's 19th Birthday.
Everyone of the documents for this case are wrong, nothing has ever been done to change any of it. No DNA was ever taken at the crime scene, nor was his moranda rights ever read to him. The Police who arrested him were out of their Jurisdiction. And none of this was ever brought up in court. The Judge was not even paying attention to the case and was sitting up on the bench reading a book throughout the whole Preliminary Hearing. This case never went to trial, and there was never a Jury Selected.
Boyd was so scared and knew that he could not get a Fair Trial so he pleaded No Contest. And was given 2 1/2 Years in Hutchison Correctional Facility in Hutchison Ks.
Then after that he was brought back to Wyandotte County and was susposed to only be in there for 60 days until they knew what to do next. He was in there 111 days. This is the 60 Day law that we are waiting on a appeal to be handed down from the Kansas Appealite Courts. And this is what will adventually free him.
Right now he is the Larned State Hospital in Larned Kansas, receiving treatment, that is considered unfair and inadiquate, by not only the family,friends and associates, also by the Kansas Supreme Court, that this whole program is Unconstitutional, and was the only one in Kansas to remain running in full operation.
We are just asking for this to be signed in the name of Justice, and freedom for someone who has been locked up now as an innocent man for almost 7 years.
We want him to be able to be free, and to start a life over, and then one day have the charges dropped.
We ask for this blessing in Gods Will, and with the love of family and Friends that Boyd Stanley Huntington III be released soon.
