Motion to disqualify Zardari and Sharif from holding public office

To:  The Honorable Supreme Court of Islamic Republic of Pakistan

This petition is hereby filed on behalf of citizens of Islamic Republic of Pakistan. We respectfully request this honorable court and its respected judges to disqualify Mr. Asif Ali Zardari and Mr. Mian Muhammad Nawaz Sharif from holding any public office and from contesting in any public elections, on grounds of corruption and treason. Treason here is defined by the acts of taking measures and decisions which instead of being beneficial to the nation, are rather harmful and destructive to the well being of Pakistan and her citizens.

As of today, when inflation has sky rocketed, foreign reserves are at a record low, religious extremism is at its peak and amongst all this chaos, people of Pakistan are deprived of basic necessities for a peaceful livelihood, the defendants being not only the richest and wealthiest but also powerful, have done nothing for the people. The very basic definition of democracy describes them as public servants, and ironically, these servants are living their respective lives far better off than the ordinary citizens. For over two decades, they have stolen from our treasury, mocked us, and abused our trust in them.

Mr. Zardari is enjoying amnesty from all his crimes under the N.R.O. act, and it is no hidden secret that the masses want accountability for all the corruption that took place right under his nose. The N.R.O. approach encourages the politicians to follow in the footsteps of Mr. Zardari and in the long run, we will only see more and more corruption. It is the duty of the Supreme Court of Pakistan to put an end to such amnesties and discourage anyone from looting the national treasury ever again by making an example out of the likes of Mr. Zardari.

Mr. Nawaz Sharif is yet to answer us, as to whatever happened to the millions of rupees which were donated by the generous citizens of Pakistan to pay off the nation's immense debt, under the infamous "Qarz Utaro Mulk Sanwaro" scam. Let the honorable court not forget that it was the same Mr. Nawaz Sharif who made a mockery of the judicial system by having a mob of his goons attack the Supreme Court's building. Let the honorable court not forget how former chief justice Mr. Sajjad Ali Shah was treated by Mr. Nawaz Sharif. Let the honorable court also not forget that as per a previous ruling he is not eligible to participate in political activities inside Pakistan, yet he led the "Long March" of 2009 and urged the people not to respect law and order and engage in civil disobedience. We request the court to dismiss his role in the restoration of judiciary movement of 2009, when considering this petition, since not doing so will only cause your sympathies to lean towards him. Past two decades are a proof of the cunning personality of Mr. Nawaz Sharif and also of the fact as to what limits he can reach beyond to get matters resolved the way it pleases him.

Given the current political structure, we see it to be almost impossible, to get out of this web of deception and corruption. There is no possible way to conduct elections in the country without them rigging the process, hence depriving us of the option to follow the process described in the current constitution. Unfortunately, we are left with only this option. If a party has the right to form its government by only getting partial recognition from the whole country in the polls, then by all means, we the citizens, have an equal right to file such a petition with the highest authority of law in the country.

Recently, the judicial system of Pakistan has won its so called battle for independence and supremacy, now is the time to be practical and show us how sincere this system was in its cause. If the honorable court and its respected judges do not take this petition in consideration, it will only lead us into believing that our judicial system is no different than our political system; both lie to us to get our emotions stirred, to get our sympathies, to get our support for their rallies and protests, and once their missions are accomplished, we are soon forgotten, until of course, the next crisis cooks. This petition will be a chapter in the history books for our generations to come, so when they ask their elders as to who was responsible for the downfall of the country, those elders can point their fingers at our judicial system. Yes, they will tell their children that the very guardians of law and order led them to their downfall.

We hope that this honorable court and its respected judges do not wish for all this to come true, and will take a decisive action, for once, as per the will of the citizens of Pakistan
