On March 17, 2003, the Vietnamese authorities, taking advantage of the tension in the world caused by the war in Iraq, re-arrested Dr. Nguyen Dan Que, a prominent democracy and human rights advocate, for trying to disseminate a statement on the freedom of information, which he says is lacking in Vietnam. In his statement, Dr. Que asserts that the Vietnamese authorities have tried to confuse the issue by claiming that Vietnam has up to 486 newspapers and magazines and that the majority of Vietnamese can get access to radio and TV broadcasts, proof-the authorities say-that Vietnam has full freedom of information. However, Dr. Que says, the government failed to disprove the fact that all these publications, radio and TV stations are in the hands of the state, with no exception.

Since 1975, Dr. Que has consistently spoken on behalf of democracy and human rights for Vietnam. Held in jail without trial from 1978 to 1988 for criticizing the health care system under the new regime, Dr. Que was re-arrested in 1990 and sentenced to 20 years in prison for launching a non-violent movement entitled “The High Tide of Humanism.” As a result of interventions by numerous Free World governments, he was released in 1998 on condition that he left the country; however, he declined the offer and decided to remain in Vietnam to keep advocating for his beliefs. Last year he openly protested against the Communist government's concessions of borderland and territorial waters to China.

Dr. Que’s advocacy is entirely non-violent in nature and based on universally recognized human rights, as found in the 1948 Universal Declaration of Human Rights, especially such rights as freedoms of expression, reception and dissemination of information. These rights are further guaranteed by Article 19 of the International Covenant on Civil and Political Rights that the government in Hanoi has ratified since September 1982 and pledged to enforce.

For the above reasons, the undersigned individuals and organizations unanimously:

1. Demand that Hanoi immediately release Dr Nguyen Dan Que as well as all other religious leaders and democracy and human rights advocates currently under detentions or house arrests.
2. Call on the free governments and human rights organizations in the world to use their influence for pressuring Hanoi to respect human rights and cease all fabricated charges against non-violent human rights workers and advocates; and
3. Request the United States Congress to pass the Human Rights Bill for Vietnam as early as possible to help the Vietnamese people to have their condition improved by having a true democracy political system and their human rights respected.

VỀ VIỆC BÁC SĨ NGUYỄN ĐAN QUẾ BỊ BẮT LẠI

Ngày 17-3-2003, lợi dụng lúc t́nh h́nh thế giới đang căng thẳng v́ nguy cơ chiến tranh tại Iraq, nhà cầm quyền Cộng Sản Việt Nam (CSVN) đă bắt lại Bác Sĩ Nguyễn Đan Quế, một nhà tranh đấu cho dân chủ và nhân quyền tại Việt Nam, v́ BS Quế phổ biến một bản lên tiếng đ̣i quyền tự do thông tin ở Việt Nam. Oâng tố cáo sự lừa bịp của CSVN khi nói rằng Việt Nam có tự do báo chí với 486 tờ báo được phát hành và đa số dân Việt Nam được nghe phát thanh và xem truyền h́nh, mà thực ra tất cả báo chí, đài phát thanh và truyền h́nh đều nằm trong tay nhà nước.

Kể từ năm 1975, BS Quế đă không ngừng tranh đấu v́ dân chủ và nhân quyền cho Việt Nam. Ôâng đă bị CSVN cầm tù không có án từ năm 1978 đến năm 1988 v́ đă chỉ trích hệ thống y tế của họ. Đến năm 1990, BS Quế đă bị bắt lại rồi bị kết án 20 năm tù v́ đă phát động “Cao Trào Nhân Bản”, một phong trào đấu tranh bất bạo động. Nhờ áp lực của quốc tế và đồng bào khắp nơi, năm 1998 ông được phóng thích với điều kiện phải sống lưu vong, nhưng ông cương quyết ở lại Việt Nam để tiếp tục tranh đấu. Gần đây ông đă công khai cực lực phản đối CSVN đă nhượng đất đai và lănh hải cho Trung Quốc.

BS NguyễƠn Đan Quế đă tranh đấu hoàn toàn bất bạo động cho các nhân quyền phổ quát đă được minh định trong bản Tuyên Ngôn Quốc Tế Nhân Quyền, đặc biệt là các quyền tự do phát biểu và tiếp nhận cùng phổ biến tin tức. Những quyền này c̣n được bảo đăm bởi Điều 19 của bản Công Ước Quốc Tế Về Những Quyền Dân Sự Và Chính Trị mà nhà cầm quyền CSVN đă phê chuẩn vào tháng 9-1982 và cam kết tuân hành.

V́ những lư do vừa nêu trên, các đoàn thể và tổ chức có tên dưới đây đồng ḷng:

Đ̣i hỏi nhà cầm quyền Hà Nội trả tự do ngay cho BS Nguyễn Đan Quế cũng như tất cả các vị lănh đạo tôn giáo và những người tranh đấu cho dân chủ và nhân quyền hiện đang bị giam cầm hoặc quản chế.
Kêu gọi các quốc gia tự do và tổ chức nhân quyền trên thế giới dùng ảnh hưởng và uy tín sẵn có để tạo áp lực buộc nhà cầm quyền Việt Nam phải tôn trọng nhân quyền và chấm dứt mọi vu cáo hoặc ngụy tạo tội danh để bắt bớ, giam cầm những người chỉ đ̣i hỏi nhân quyền một cách bất bạo động; và
Yêu cầu Quốc Hội Hoa Kỳ sớm thông qua Dự Luật Nhân Quyền Việt Nam để giúp dân tộc Việt Nam cải thiện đời sống nhờ hưởng được dân chủ và nhân quyền thực sự.
