Support Texas House Bill 939

Texas Family Code Sec. 154.132 has been denied by the 1st Court of Appeals (the court that handles my court in the 309th) and it was mentioned that the legislature needed to decide how to handle the situation. However, we see state law 154.132 has decided. If my court was in Bexar county I would be supported.

This is important to me and all disabled citizens who owe child support. My children have collected over $18,000. I am ordered to pay $175/month and the state avows this is $13,000.

If this bill doesn't pass my children will collect $493/month and the state will start accumulating 6% interest on the $13,000. I earn less than $1000/month; pay $375 rent, $75/month on medication, $120/month to see doctors and around $225 in utilities not to mention a measly $125 a month on food for a diabetic. How am I to pay 6% interest on $13,000?

A BILL TO BE ENTITLED
AN ACT
relating to the application of certain disability payments in connection with a claim for child support arrearages.

AFFIRMATIVE DEFENSE TO MOTION FOR ENFORCEMENT OF CHILD SUPPORT: DISABILITY PAYMENTS. (a) This section applies only to an obligor who has a disability and who is required to pay support for a child who receives benefits as a result of the obligor's disability.

Texas Family Code Sec. 154.132. APPLICATION OF GUIDELINES TO CHILDREN OF CERTAIN DISABLED OBLIGORS. (a) In applying the child support guidelines for an obligor who has a disability and who is required to pay support for a child who receives benefits as a result of the obligor's disability, the court shall apply the guidelines by determining the amount of child support that would be ordered under the child support guidelines and subtracting from that total the amount of benefits or the value of the benefits paid to or for the child as a result of the obligor's disability.
