To:  Take-Two Interactive Software, Inc.

Take-Two Interactive Software, Inc. is the exclusive manufacturer of MLB licensed video games. With that there should be a dedication to the consumer to provide them with a phenomenal product. On March 2, 2009 2K Sports MLB 2K9 was released for a MSRP of $59.99 (Microsoft Xbox 360/ Sony Playstation 3). The game was highly anticipated after years of continued improvements in all aspects.

Once the game hit the market all that anticipation was met with disappointment by a majority of the people who purchased the game. As it has been posted openly in 2K Sports open forums (property of Take-Two Interactive Software, Inc.) there are many major flaws that make the game virtually unplayable.

The list of flaws/errors/glitches is far too long to list. The main glitches that make the product virtually unplayable are:
-The fielding errors; specifically in reference to the first baseman coming off the bag or not even attempting to field the throw on routine plays.
-Base running in reference to leads/pickoffs is totally off.
-Injuries are far too common and make the franchise modes unplayable.
-The normal difficulty settings are not realistic and after a few games of unrealistic outcomes it becomes unplayable.
-Online leagues have countless errors when it comes to setting up many aspects of the rosters.
-The AI is far too aggressive at the plate and led to yet more unrealistic statistical outcomes.
There are many more minor flaws/errors/glitches but these are the most commented about problems.

It has been stated that a patch to fix these problems will be made available in the coming weeks, possibly even months. The details of what will be fixed will is not being made available. This is unacceptable! Take-Two Interactive Software, Inc. should notify people of what is going to be fixed and exact dates should be given.

This game should never have been released. It is riddled with flaws and the lack of communication that Take-Two Interactive Software, Inc. has had with the gaming public is laughable. The only comment that has been made is that some, but not all the problems will be fixed. It is in my opinion that a full refund should be issued to anyone who purchased this game. As the people who pay your bills you owe it to us to put out a great game. With the state of the economy, and more so the gaming industry, extra attention should have been put into this game. You hold the exclusive contract with MLB and I know that they would be disappointed if they knew what all the consumers and even many of the award winning gaming sites were saying about this game. I know there are a good deal of former employees of Electronic Arts that would be thrilled to make an award winning game….. They did it once, and I’m sure they could do it again!

With all this being said I feel that Take-Two Interactive Software, Inc. should issue a full refund to the people who so feel that one is needed. This game is horrible in not only my opinion, but also a majority of the gaming community. There have been recalls made before and this is one that should be. When a game becomes unplayable then there should be compensation.

I urge you all to sign this petition if you feel that a full refund should be issued to anyone who purchased MLB 2K9 which is produced by Take-Two Interactive Software, Inc.

Sincerely,

The Undersigned
