Below please find a list of resolutions regarding the ongoing violence against women in Juarez and Chihuahua City in Mexico. These resolutions were drawn up by a group of family members of the victims, artists and activists working in solidarity with them, and scholars whose research is contributing to bringing an end to this terrible wave of violence. Resolutions of the International Conference
“The Maquiladora Murders, Or, Who Is Killing the Women of Juárez?”
Hosted by the Chicano Studies Research Center at UCLA*

Recorded in Los Angeles, California, November 1st, 2003.

1. We declare that the kidnappings, tortures, and murders of girls and women in Ciudad Juárez and in the state of Chihuahua, committed since 1993 to the present, are crimes against humanity and we demand that their solution become a high priority in the binational and international agendas for the defense of human rights.

2. We demand that the governments of Mexico and the United States intervene in the investigation and solution of these murders, as part of their binational obligations to protect and defend the human rights of all inhabitants of the border area.

3. We demand that Mexico and the United States establish effective technical-legal cooperation and leads in order to investigate the linkages between transnational organized crime and the murders in Ciudad Juárez.

4. We demand that Hilda Solís, Democratic Congresswoman for the 32nd District of California, and Guadalupe Morfín Otero, Mexican Sub-Commissioner for the Prevention and Eradication of Violence Against Women in Ciudad Juárez, organize a binational alliance to intervene in clearing up the murders of girls and women in the region.

5. We demand an in-depth binational and international investigation into the identities of those individuals who might have information about the facts surrounding the murders of women of Ciudad Juárez, or who could be involved in them, and whose names have been denounced by the newspapers La Jornada and Reforma of October17 and 31, respectively.

6. We demand the formation of a binational and international human rights commission that:
a. investigates each and all of the cases of the murdered women;
b. has the authority to protect the life and safety of mothers, families, and friends of the victims, as well as that of the informants and defenders of human rights working on the cases;
c. has binational jurisdiction and capacity to impose sanctions; and
d. establishes a Mexico-United States human rights binational agreement to prevent future murders.

7. We demand that any commission formed by the governments of Mexico and the United States to investigate these crimes be designed in accordance with the human rights criteria established by the United Nations (Convention to Eliminate All Forms of Discrimination Against Women and the Convention to Prevent, Sanction, and Eradicate Violence Against Women by Belem do Pará), so that it effectively addresses the murders of the girls and women of Ciudad Juárez and the state of Chihuahua.

8. We demand that the commission be granted the necessary functions and authority to discover the truth about the crimes, to carry out justice, and to permanently halt the murders and any kind of violence against the girls and women of Ciudad Juárez and the state of Chihuahua.

9. We demand that the human rights commissions and the international and Inter-American Courts of Justice acknowledge our demands and make the pertinent recommendations to our governments, exposing them before the international community in case they do not meet those recommendations.

10. We demand that the report written by the mission of experts from the United Nations who visited Ciudad Juárez in October 2003, directly examined some of the files of the cases of murdered and disappeared girls and women, and provided their technical-legal expertise to Mexican authorities, be made public and be widely distributed.

11. We demand economic reparation for the families of the murdered, disappeared, tortured, and raped girls and women of Ciudad Juárez and Chihuahua for the moral injury inflicted and the emotional pain and distress caused by the failure of the government to investigate properly the commission of these crimes.

12. We demand that the government of Ciudad Juárez, its planning entities, and major employers in the region work jointly to provide the necessary infrastructure that will make Ciudad Juárez a safer place for everybody, in which women can have the freedom of movement, as any other human being, without fearing for their lives and their safety.

Esta es una lista de resoluciones relacionadas con la violencia contra las mujeres de Juárez y Ciudad Chihuahua en México. Estas resoluciones fueron compuestas por un grupo de familiares de las víctmas, artistas y activistas que trabajan en solidaridad con ellos e investigadores cuyo trabajo contribuye al esfuerzo de llevar a cabo esta terrible hola de violencia. Resoluciones de la Conferencia
“Maquilando Mujeres en Juárez o ¿Quiénes Son Los Asesinos?”
Patrocinada por el Centro de Investigaciones de Estudios Chicanos en UCLA*

Elaboradas en Los Angeles, California el 1º de Noviembre de 2003.

1. Declaramos que los secuestros, torturas y asesinatos de niñas y mujeres de Ciudad Juárez y del estado de Chihuahua, cometidos desde 1993 hasta la fecha, son crímenes contra la humanidad y exigimos que su solución se convierta en máxima prioridad en la agenda por la defensa de los derechos humanos a nivel binacional e internacional.

2. Exigimos que los gobiernos de México y los Estados Unidos intervengan en la averiguación y solución de estos asesinatos como parte de sus obligaciones bilaterales de proteger y defender los derechos humanos de todos los habitantes de la franja fronteriza.

3. Exigimos que se establezcan cooperación técnico-jurídica y líneas de investigación efectivas entre México y los Estados Unidos para averiguar los vínculos entre la delincuencia transnacional organizada y los asesinatos en Ciudad Juárez.

4. Exigimos que Hilda Solís, Congresista Demócrata del 32º Distrito de California, y Guadalupe Morfín Otero, Subcomisionada para Prevenir y Erradicar la Violencia Contra las Mujeres en Ciudad Juárez, formen una alianza binacional que intervenga en el esclarecimiento de los asesinatos de niñas y mujeres en la región.

5. Exigimos una intensa investigación binacional e internacional de las identidades de los individuos que podrían poseeer información acerca de los hechos que rodean los asesinatos de las mujeres de Ciudad Juárez o que podrían estar involucradas en ellos y cuyos nombres ya se han denunciado en los periódicos Reforma y La Jornada de los días 17 y 31 de octubre, respectivamente.

6. Exigimos que se conforme una comisión binacional e internacional de derechos humanos que:
a) investigue todos y cada uno de los casos de las mujeres asesinadas;
b) tenga autoridad para proteger la vida y seguridad de las madres, familias y amigos de las víctimas, así como de los informantes y defensores de los derechos humanos que trabajan en los casos;
c) tenga competencia binacional y capacidad de imponer sanciones; y
d) establezca un convenio binacional de derechos humanos entre México y los Estados Unidos que prevenga futuros asesinatos.

7. Exigimos que cualquier comisión formada por los gobiernos de Mexico y los Estados Unidos para investigar estos crímenes se constituya de acuerdo con los instrumentos de derechos humanos establecidos por las Naciones Unidas (Convención para Eliminar Todas las Formas de Discriminación a la Mujer y Convención para Prevenir, Sancionar y Erradicar la Violencia a la Mujer de Belem do Pará) para que efectivamente aborde los asesinatos de niñas y mujeres de Ciudad Juárez y del estado de Chihuahua.

8. Exigimos que se faculte a la comisión con las funciones y autoridad necesarias para que pueda llegar a la verdad de los crímenes, para que se haga justicia y para detener de manera definitiva los asesinatos y cualquier forma de violencia a las mujeres y niñas de Ciudad Juárez y del estado de Chihuahua.

9. Exigimos que las comisiones de derechos humanos internacionales y las cortes interamericanas e internacionales de justicia admitan nuestras demandas y hagan las recomendaciones pertinentes a nuestros gobiernos, poniéndolos en evidencia ante la comunidad internacional en caso de que no cumplan esas recomendaciones.

10. Exigimos que se haga público y que se distribuya ampliamente el informe que elaboró la misión de expertos de las Naciones Unidas, la cual estuvo en Ciudad Juárez en octubre pasado, examinó directamente algunos de los expedientes de casos de niñas y mujeres asesinadas y desaparecidas, y proporcionó cooperación técnico-jurídica a las autoridades mexicanas.

11. Exigimos una reparación económica para las familias de las mujeres y de las niñas asesinadas, desaparecidas, torturadas y violadas en Ciudad Juárez y en Chihuahua por el daño moral sufrido, por el dolor emocional y la zozobra motivados por el fracaso del gobierno de investigar adecuadamente la perpetración de estos crímenes.

12. Exigimos que el gobierno de Ciudad Juárez, sus instancias de planificación y los principales empleadores en la región trabajen conjuntamente para proveer la infraestructura necesaria que haga de Ciudad Juárez un lugar más seguro para todos y en el que las mujeres puedan tener la libertad de circular libremente, como cualquier otro ser humano, sin tener que temer por sus vidas o su seguridad.
