To Halt Blasting Immediately In Tennessee

To:  Tennessee State Senate & House

I recommend that all Homeowner Blast Victims canvas the North Davidson County area and shopping centers with a formal Petition to request that a Blasting Moratorium be implemented immediately until appropriate Tennessee State Legislation is approved to :
Remove the Blast Advisory Council from the direct influence against Homeowners!

Remove the Pre-emption Rule!

Extend the Pre-blast Rule out to a 1/2 Mile Radius of Development Property Site Boundary!

Codify that Earth Movement is not an acceptable basis for Homeowner Insurance Policy "Exception" to Blast Damage!
Require that all Blast Damage Claims retroactively be re-evaluated by an Arbitrator on behalf of Blast Damage Homeowners RETROACTIVE TO 2004, WITHOUT ADVERSE FINANCIAL IMPACT TO "SETTLED BLAST DAMAGE CLAIMS" BUT INCLUSIVE TO SUCH!

State and County funded Homeowner access to Public Defender Legal Resources with all Legal Expenses of Blast Damage Victim assessed through Blasting Permit Fees!

State required Government Blast Monitor Specialist on-site with appropriate seismic monitors properly installed a minimum of 1.000 feet away from the Blasting Site in all four quadrants of direction and photographed to document correct installation to monitor and record all Commercial and Residential Blasting Events! Such costs incurred shall be assessed through Blasting Permit Fees!

Require that all State sponsored Blasting Excavation Activities be implemented without use of "ANFO" - which presents the BYPRODUCT "BENZENE" [ a known and prohibited carcinogen ] residue into the Ground Water Table!!

Ban use of "ANFO" as an explosive agent at all surface mining operations such as Rock Quarrying and Mountaintop Removal Mining within five miles of any inhabited area of Tennessee!
