Allow Noam to Remain in Switzerland - Pétition pour que Noam reste en Suisse

With warmest thanks to all of you who have already signed: on September 25, 2007, Noam's mother appealed to the European Court of Human Rights. The Strasbourg Court has asked the Swiss government not to send Noam back to Israel until further notice. We will keep you posted as we continue our fight for Human Rights. La Cour de Strasbourg a demande au gouvernement Suisse de ne pas renvoyer Noam en Israel jusqu'a ce qu'elle ait statue sur les merites de la requete. Noam is a little boy 4 years old and a Swiss citizen. His parents were married in Israel. Shortly after his birth, his father joined an ultra orthodox religious sect and demanded that Noam and his mother do likewise. When Noam’s mother refused to do so, he harassed her and even threatened to kill her. After finally obtaining a divorce and the custody of the baby, the mother fled Israel in order to save her life and protect Noam from being integrated into the sect. She returned with Noam to Switzerland, where they have been living happily for the past two years. The father has demanded Noam’s return to Israel in application of the Hague Convention. Two different Swiss courts have rejected the demand. They did so by referring to the exception allowed by the Convention, and considering that returning the child to Israel would place him in an intolerable situation and gravely jeopardize his development. Unfortunately, the Federal Tribunal reversed both previous court decisions, and has ordered Noam’s return to Israel at the end of September 2007. If his mother goes back with him, she will most probably go to prison and be subjected to reprisals from the father, who moreover never contributed to the child's support. If Noam goes alone, it will cause him an irreversible trauma: he will be separated from his mother, sent to a country he doesn't know, and left with a father who would send him to one of the sect's religious schools.
Please, help us to correct this injustice and sign this petition to allow Noam to stay in Switzerland. Thank you.

We act as citizens concerned with the protection of children and the safeguard of human rights and fundamental liberties. We request that the leaders of our country take all measures to allow Noam to remain in Switzerland.

Noam est un petit garçon suisse de 4 ans. Ses parents se sont mariés en Israël. Peu après sa naissance, son père a rejoint une secte religieuse ultra-orthodoxe et a tenté d'obliger Noam et sa maman à faire de même, n'hésitant pas à harceler et menacer de mort la maman. Après avoir enfin obtenu le divorce et la garde de Noam, sa maman a fui Israël pour protéger sa vie et soustraire son enfant à la secte. Elle est revenue avec Noam en Suisse, où ils vivent heureux depuis plus de deux ans. Invoquant la Convention de la Haye, le père de Noam a exigé son retour en Israël. Deux tribunaux vaudois ont rejeté cette demande, appliquant l'exception prévue par la Convention et considérant que le retour en Israël de ce très jeune enfant le placerait dans une situation intolérable et compromettrait gravement son développement. Mais le Tribunal fédéral vient de décider de renvoyer Noam en Israël à la fin du mois de septembre 2007.
Si sa maman l'accompagne, elle risque la prison et les représailles du père, qui n'a de plus jamais contribué à l'entretien de Noam.
Si Noam devait partir seul, il subirait un traumatisme irréparable: se retrouver sans sa maman, dans un pays qu'il ne connaît pas, dont il ne parle pas la langue et avec un père qui pourrait le placer dans une institution religieuse de la secte. S'il vous plaît, aidez-nous à éviter cela et signez pour que Noam puisse rester en Suisse. De tout cœur, merci.

Nous agissons en qualité de citoyens concernés par la protection des enfants et la sauvegarde des droits de l'homme et des libertés fondamentales, et nous demandons à nos dirigeants de prendre des mesures pour que Noam reste en Suisse.
