Dear President Bush,

On January 5, 2006 you signed the IMBRA Act Marriage Broker Regulation (IMBRA). A 60-day deadline, March 5, 2006, was established for DHS to begin asking K-1 fiancé(e) petitioners for their criminal background information. DHS did not meet the deadline for collecting additional information. Most K-1 cases under the new IMBRA requirements were held at the service centers pending development of a new form I-129F. This new form was not available until June 15th, 2006.

This "new form" could have been a simple PDF form that was available the day you signed the law. Since this form was not available from USCIS, 10,000+ pieces of mail had to go out to all those that submitted the old form.

The inability to get the new, one page form on the USCIS website is now causing one of the longest delays in the processing of I-129F forms, specifically at the California Servicing Center. While others who have and continue to file at Vermont Servicing Center are approved in a matter of a few months or less, many of us are waiting five months or longer for the California Servicing Center.

In 2003, Mr. Eduardo Aguirre (former USCIS Director) and you stated, "Legal immigrants should be greeted with open arms, not long lines." In addition, you set forth goals in 2001 to have all processing of applications take six months or less with the "Backlog Elimination Plan" at USCIS.

It is evident that there is no accountability at the USCIS. The following people in this petition request that a Congressional Inquiry be placed on USCIS practices and procedures.
