Prevent The Deportation Of David Wong

To:  UNITED STATES IMMIGRATION AND CUSTOMS ENFORCEMENT and CONGRESS

We urge your support to prevent the deportation of David Wong and to allow him to live with his relatives, friends and supporters in the United States.

In 1986, David Wong was 24 years old when a prison guard coached a witness to lie and falsely identify David Wong as the person who committed a murder. There was no physical evidence or motive to link David to the killing. David's trial lawyers visited him twice in the fifteen months prior to the trial and both times without a translator. At his trial, David was not given a qualified interpreter in his Chinese dialect.

Eighteen years passed before an appellate court in 2004 overturned the murder conviction in a unanimous opinion. David was 41 years old by the time he was finally cleared. He lost the prime years of his life due to the wrongful conviction that was based on false, coached testimony. In prison, he earned a diploma, has studied extensively, and would like to be a youth counselor to dispel misconceptions about life in penitentiaries.

David Wong has extremely broad community support and has close relatives and friends in the United States who will support him. Deporting him will cause adverse publicity against the government and add to the injustice David has endured.

David’s health has deteriorated while serving time for a crime he did not commit. He now suffers from emphysema.

Based on the grave injustice that David Wong suffered, his extensive community support, humanitarian reasons, and in the interest of fairness and justice, David Wong must be allowed to remain in the United States.

We urge ICE to exercise its prosecutorial discretion and for Congress to take action to prevent this deportation. Let David Wong begin the next chapter of his life amongst his relatives, friends and supporters.
