Xét rằng :

- Biến cố 30/4/1975 đã đưa chính quyền Việt Nam Cộng Hòa vào thế bị động, các cơ cấu từ Quốc Hội Lưỡng Viện, hành chánh, tài chánh đến quân đội đều tạm ngưng hoạt động và nhân dân bị phân tán.
- Cũng vào thời điểm này 30/4/1975 lãnh thổ Việt Nam Cộng Hòa từ vĩ tuyến 17 trở xuống, đã bị Cộng sản Bắc Việt cưỡng chiếm bất chấp hiệp định Geneve 20/7/1954, hiệp định Paris 27/1/1973 và nguyên tắc công pháp quốc tế.
- Sau ngày 30/4/1975 Toàn thể Quân, Dân, Cán, Chính Việt Nam Cộng Hòa đều bị cầm tù đày ải sát hại bởi Cộng Sản Bắc Việt, trừ một số đã phải di chuyển ra ngoài lãnh thổ.
Sau khi duyệt qua về tình hình bi thảm của đất nước, sự tàn bạo, dối trá và gian manh của Cộng Sản Bắc Việt, trách nhiệm của Liên Hiệp Quốc và Ủy Ban Quốc tế Kiểm Soát và Giám sát, chiếu theo điều 4, 5, 25, 26, 30, 39, 47, 50 và 86 của Hiến pháp Việt Nam Cộng Hòa, chúng tôi, Quân Dân Cán Chính Việt Nam Cộng Hòa có tên dưới đây bao gồm các cơ cấu hành pháp, tư pháp, lập pháp, giám sát, nhân Ngày Đại Hội Việt Nam Cộng Hòa lần đầu tiên sau 33 năm đất nước bị Cộng Sản Bắc Việt cưỡng chiếm, tự xét mình vẩn còn bổn phận và trách nhiệm.

Nay long trọng tuyên bố :

1/ Chiếu điều 42 và 56 hiến pháp của Việt Nam Cộng Hòa, sự trao quyền giữa Tổng Thống Trần Văn Hương và Đại Tướng Dương Văn Minh là hoàn toàn vi hiến.
2/ Cộng Sản Bắc Việt mà nay là Cộng Hòa Xã hội Chủ Nghĩa Việt Nam đã tự ý chà đạp Hiệp Định Paris ký ngày 27/1/1973 để xâm lăng Việt Nam Cộng Hòa.
3/ Chính thể Việt Nam Cộng Hòa vẫn tồn tại.
- Lưỡng Viện Quốc Hội vẫn hiện hữu và vẫn còn trách nhiệm với quốc dân.

Nay long trọng thỉnh cầu:

1/ Thủ Tướng Nguyễn Bá Cẩn và nội các chính phủ tiếp tục nhiệm vụ vì sự toàn vẹn lãnh thổ và lãnh hải.
2/ Các Nước tham dự Hội Nghị Paris chiếu theo điều 19 và Ủy Ban Quốc Tế Kiểm Soát và Giám Sát gồm các nước sau đây:
- Gia Nã Ðại ( Canada)
- Hung Gia Lợi (Hungary)
- Indonesia
- Ba lan (Poland)
Cần triệu tập một Hội Nghị khẩn cấp các Thành viên liên hệ để xét lại tiến trình thực thi Hiệp Định Paris đã ký ngày 27/1/1973.
3/ Các nước đã ký Hiệp Ðịnh Ba Lê áp dụng điều VII và các nước yêu chuộng tự do dân chủ trên thế giới, đã từng đặt nền tảng bang giao với Việt Nam Cộng Hòa hãy hỗ trợ và giúp đỡ cho chúng tôi trong giai đoạn khó khăn nầy.

The Declaration of the Citizens Assembly of the Republic of Vietnam held at 8200 Westminster, California, the 28th of June 2008.
IN CONSIDERATION THAT:
-The events of the 30th of April 1975 paralyzed the viable function of the Republic of Vietnam.
-The territory of the Republic of Vietnam was invaded by the communists of north-Vietnam, in spite of the Geneva Convention, signed the 20th of July 1954 and the Paris Convention signed the 27th of January 1973, in contravention with all the principles of international law.
-After the events of the 30th of April 1975, the citizens of the Republic of South Vietnam where all persecuted with the exception of a minority few that were able to escape.
-After examining the dramatic situation of the homeland , passing in review of the duplicity and inhumanity of the conquering communist north vietnamese, weighing on the responsibility of the United Nations Organizations (O.N.U.) including the international Commission that surveyed and controlled the Paris Convention, and in conformity with the Articles 3, 4, 5, 25, 26, 30, 39, 50 and 65 of the Republic of Vietnam‘s Constitution, we, the citizens of the said Republic of different origins and horizons,
SOLEMNLY DECLARE THE FOLLOWING:
1. The transfer of power between President Tran Van Huong and the General Duong Van Minh is in contravention with articles 42 and 56 of the Constitution of the Republic of Vietnam , which renders it unconstitutional.
2. The north Vietnamese communists known namely as the Democratic Republic of Vietnam inexcusably trampled over the Paris convention signed on the 27 of January 1973 by invading south Vietnam.
3. The continuation of the state of the Republic of Vietnam cannot be denied. The existing two chambers of the National Assembly can still function to serve the population.
AND INVITE:
1. The Prime Minister Nguyen Ba Can and his Cabinet, to assume his responsibility to preserve the integrity of the homeland.
2. The international Commission who surveyed and controlled the Paris Convention, including, Canada, Hungary, Indonesia and Poland, in accordance with article 19 of the said Convention, to reunite the participants of the Paris Conference on Vietnam to further examine the situation.
3. The countries signatories of the final act of the international conference of Paris for Vietnam to put forth the application of article VII and help us during this difficult time. We also hope to call upon all the countries with friendly ties and relations with the Republic of Vietnam to assist us in our purpose.

DÉCLARATION DE L’ASSEMBLÉE DES CITOYENS DE LA RÉPUBLIQUE DU VIETNAM TENUE AU 8200 WESTMINSTER, CALIFORNIA, LE 28 JUIN 2008.

ATTENDU QUE :
-L’événement du 30 avril 1975 a paralysé le fonctionnement de la République du Vietnam;
-Le territoire de la République du Vietnam a été envahi par les communistes nord-vietnamiens en dépit du Traité de Genève signé le 20 juillet 1954 et du Traité de Paris signé le 27 janvier 1973, et ce, à l’encontre des principes du droit international;
-Suite à cet événement du 30 avril 1975, les citoyens de la République du Vietnam ont tous été persécutés à l’exception d’une minorité ayant pu s’échapper.
Après avoir examiné la situation dramatique de la patrie, passé en revue la duplicité et l’inhumanité des conquérants communistes nord-vietnamiens et soupesé la responsabilité de l’Organisation des Nations Unis (O.N.U.) et celle de la Commission internationale de contrôle et de surveillance du Traité de Paris et en conformité avec les articles 3, 4, 5, 25, 26, 30, 39, 50 et 65 de la Constitution de la République du Vietnam, nous, les citoyens de ladite République provenant de divers horizons,
DÉCLARONS SOLENNELLEMENT CE QUI SUIT :
1. La passation de pouvoir entre le Président Tran Van Huong et le Général Duong Van Minh est en contravention avec les articles 42 et 56 de la Constitution de la République du Vietnam, ce qui la rend inconstitutionnelle.

2. Les communistes nord-vietnamiens, connus nommément comme la République démocratique du Vietnam, ont piétiné le Traité de Paris signé le 27 janvier 1973 en envahissant le sud Vietnam;

3. La continuité d’état de la République du Vietnam est incontestable. Son Assemblée nationale avec ses deux chambres est encore en fonction pour servir sa population;
ET PRIONS :
1. Le Premier Ministre Nguyen Ba Can et son Cabinet de bien vouloir assumer sa responsabilité pour préserver l’intégralité de la patrie;

2. La Commission internationale de contrôle et de surveillance du Traité de Paris comprenant le Canada, la Hongrie, l’Indonésie et la Pologne de bien vouloir, en vertu de l’article 19 dudit Traité, réunir les participants à la Conférence de Paris sur le Vietnam pour examiner la situation.
3. Les pays ayant signé le texte de l’Acte final de la Conférence internationale de Paris sur le Vietnam de bien vouloir mettre en application l’article VII pour nous venir en aide dans ces temps difficiles. Nous faisons aussi appel aux pays amis ayant eu des relations avec la République du Vietnam pour nous assister dans notre démarche.
