Apple unfairly targets iPod Touch owners for fees

Apple unfairly charges iPod Touch owners for firmware updates while not charging iPhone owners this same charge.

Since the iPhone and the iPod Touch are both equivalent devices, less the cell phone, camera, bluetooth and microphone on the iPod Touch, the firmware on both devices appears identical. Thus, because both devices share a common firmware, the same firmware charge should apply to all devices that use this same firmware or there should be no charge at all.

This petition serves to request that Apple either remove the charges for firmware updates on the iPod Touch or apply charges equally to all devices that share this same firmware. To not charge for firmware on one device and charge for it on another is inequitable, discriminatory and unfairly targets and penalizes iPod Touch owners for their device choice. Yet, iPhone owners do not have to pay for firmware updates.

Because both devices share the same firmware and Apple wants to apply a fee to it, I see this firmware as a platform in itself. A platform that is not bound by hardware. A platform that is a product in itself. Applying any fee to the firmware clearly shows that this firmware is now a standalone product. A product that deserves its own SKU and cost structure. A cost structure that should apply to all devices equally that use this same firmware.

As a result of this firmware platform being a standalone product, Apple should charge iPhone and iPod Touch users (or any other future devices that use this platform) this same fee or no fee should be charged.
