We, the undersigned, formally request your intercession by reason of a miscarriage of justice in the 2002 murder conviction of Diane Fleming, sentenced to 30 years and 20 years concurrently for the death of her husband, Charles Fleming of Richmond, Virginia.
Diane Fleming, an innocent woman who passed a polygraph test, was accused of killing her husband by adding methanol, a poison, to a bottle of Gatorade that he drank.
According to Mr. Fleming's autopsy, death occurred from acute and chronic methanol poisoning.
Unknown to the court at the time of trial was empirical evidence that long-term use of the toxic sugar substitute aspartame causes death. Aspartame contains methanol and releases free methyl alcohol into the body. Charles Fleming drank 8-10 diet beverages a day with aspartame and used Equal, aspartame in powdered form, to sweeten other food and drinks.
Had Mrs. Fleming had a competent defense counsel and prosecutor, justice would dictate that one cannot be indicted without a preponderance of evidence. In brief, the source of the methanol, easily traced with modern toxilogical testing would have been investigated (the alleged source of the methanol, a bottle of Krystal Kleer windshield washer fluid was sealed). Defense counsel would not have spent the majority of his time in a one-day trial continually insisting Diane's son, the stepson of Charles Fleming committed 'the murder'.
On March 2, 2004, Dr. Marcella Fierro, the chief medical examiner for the state of Virginia refused to consider the aspartame evidence, although affidavits from medical doctors and peer-reviewed articles were submitted to substantiate aspartame poisoning as the cause of Charles Fleming's death. Dr. Fierro also refused to consult with or talk to world-wide expert on aspartame poisoning, Dr. H.J. Roberts.
To exonerate Diane Fleming, we ask the Governor to appoint a task force of impartial and objective coroners, jurists and toxicologists to review her case.
