WHY?

"Because marriage is a basic human right and an individual personal choice, resolved, the state should not interfere with same-gender couples who choose to marry and share fully and equally in the rights, responsibilities and commitment of civil marriage."

"Under any interpretation of American constitutional law, marriage is considered a basic civil right. Therefore, the government should end its discrimination by recognizing the right of same-sex couples to access civil marriage."

The California Constitution says, "A person may not
be deprived of life, liberty or property without due
process of law or denied equal protection of the laws."

The United States Constitution, in the 14th Amendment, likewise says that every one of us is entitled
to "equal protection of the laws."
