We are Evens and Sue Colas, a US family which has been denied proper documentation by the USCIS, the State Department and the US government to allow our Haitian-born children, Evens Paul Colas and Melissa Colas entry into the United States. The government blocks us from bringing our two children into the United States even though Evens is, in fact, the father.
The US government is putting our children in danger of being affected by infectious diseases, and possibly falling into the hands of pedophiles, slavers or kidnappers.
There are news releases every day with adoptive parents and agencies leaving Haiti with children by the hundreds. Recently a group of missionaries were caught crossing the border into the Dominican Republic with 31 Haitian children, some of whom were not orphans at all. The exploitation of Haitian children without parents being present worsens by the day and yet we have no way of rescuing our children.
Even though Evens is the father, and the mother passed away in 2004, there is no consideration for this mans rights as a parent. A DNA test was required by USCIS and the results were negative: Evens is not the biological father. However, it is no fault of his and no fault of the children that the mother, his late wife, Mireille Rosembert Colas was not faithful to the marriage. This does not change the role Evens has played in the lives of Evens Paul and Melissa.
Evens is in possession of documents proving his fatherhood:
1. Marriage certificate to the mother, Mireille Rosembert in 1995.
2. Archive birth certificates for both Evens Paul and Melissa naming Evens Colas the father.
3. Archive birth certificate for Mireille Rosembert.
4. Archive Decree of Death record of his wife from 2004.
5. Money transfer receipts via transfer agencies proving his support of the family.
6. Hundreds of photos showing him to be present in their lives since they were infants, including photos of him assisting in the birth of his daughter, Melissa.
7. Digital audio and video statements by the maternal grandmother, Tata Decembre, mother of Evens deceased wife, speaking to our lawyer, requesting her grandchildren be allowed to leave Haiti and live in the United States with Evens and Sue Colas.
8. Digital audio and video statements by the paternal grandmother, Marie Phanord, requesting her grandchildren be allowed to leave Haiti and live in the United States with Evens and Sue Colas.
These items were presented to the US government officials at the US Embassy in Port au Prince, January 24, 2010 and then again on January 29, 2010. The officials ignored them, stating they have no authority to do what is right but only to follow official US policy. The US government continues to refuse to release the children from Haiti and keep Evens Paul and Melissa Colas in this dangerous situation.
We, Evens and Sue Colas, citizens of the United States and the undersigned petitioners who are citizens or legal residents of the United States, petition to the United States Citizenship & Immigration Service (USCIS), the State Department, and the US Government, who are not allowing US Citizen fathers to bring their Haitian National children into the United States to immediately change policy, in the midst of this crisis, the devastation of Haiti by earthquake.
