Xbox Live Marketplace DRM Reform

The undersigned hereby request that Microsoft alter the Digital Rights Management practices currently in use for downloadable content made available on the Xbox 360 platform via Xbox Live Marketplace.

These practices which are intended to prevent piracy, place unreasonable restrictions on content which has been moved from one Xbox 360 console to another through console replacement during in and out of warranty servicing. When Xbox Live Marketplace content is purchased, it becomes available to all gamertags present on the console and is accessible when not connected to Xbox Live. When the console is replaced, the content only becomes available to the original purchasing gamertag and only when the console is continuously connected to Xbox Live.

These restrictions do not offer consideration for those who cannot maintain a persistent Internet connection and those who previously enjoyed the content before the console had to be replaced due to defects in workmanship. The only workaround offered to recover the pre-replacement level of access requires the customer perform a very inefficient and inconsistent process with Xbox Customer Service that can take weeks and requires the creation of a "dummy" Xbox Live Silver gamertag which can never be deleted.

These DRM restrictions treat legitimate customers as potential pirates which is unfair and very inconvenient for those who happily pay for the content they enjoy. Simple changes can be made to allow the customer service representatives to change the serial number the content is attached to. This would make it a very easy process for a customer to recover full access after their console is replaced while still maintaining strong anti-piracy measures for content creators.

As consumers of the great content on Xbox Live Marketplace, we would like to see Microsoft review the service's DRM policies and implement a solution to this problem that satisfies both your customers and your content creation partners.
