Felony Murder Rule Change in Florida

Our goal is to present to the Florida Legislature changes to the Felony Murder Rule (Fla. Stat. 782.04(3)) as it presently exists in the state of Florida.

We propose that Felony Murder for all felonies become uniform, and is treated as murder in the third degree and constitutes a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Specifically, we propose that the Florida Legislature strike Fla. Stat. 782.04(4), and that 782.04(3) be edited to read as follows:

The unlawful killing of a human being, when perpetrated without any design to effect death, by a person engaged in the perpetration of, or in the attempt to perpetrate, any felony is murder in the third degree and constitutes a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
