Felony Murder Rule Change in Florida

Our goal is to present to the Florida Legislature changes to the “Felony Murder Rule” (Fla. Stat. § 782.04(3)) as it presently exists in the state of Florida.

We propose that “Felony Murder” for all felonies become uniform, and is treated as murder in the third degree and constitutes a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

Specifically, we propose that the Florida Legislature strike Fla. Stat. 782.04(4), and that § 782.04(3) be edited to read as follows:

The unlawful killing of a human being, when perpetrated without any design to effect death, by a person engaged in the perpetration of, or in the attempt to perpetrate, any felony is murder in the third degree and constitutes a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.
