A letter to Mrs. Hillary Clinton about the degradation of the state of human rights in Syria

Dear Mrs. Hillary Clinton,

We write to you to voice our sincere concern for the degradation of the state of human rights in Syria. This deterioration of freedom and human rights is the result of systematic abuses by the Syrian regime which are illegal and un-constitutional in Syria, and concurrently, in violation of the International Declaration of Human Rights and other international treaties that have been signed by the Syrian regime. Syria has witnessed, particularly during the last six months, a dangerous deterioration of human rights to a level that has not been seen since the early 1980s. On the ground, we are noticing a steady increase in crackdowns on basic human freedoms and those who defend those freedoms.
The latest example of this progressive deterioration is the detention of the head of the Syrian human rights organization Sawasiyah and human rights lawyer Muhannad al-Hasany. Al-Hasany is known for his courageous defense of Syrian prisoners of conscience—those individuals who have committed the crime merely of speaking their mind and voicing their opposition to Syria’s totalitarian regime. His reports on the many cases of human rights abuse in Syria are frequently used as a reference by international human rights organizations such as Human Rights Watch, Amnesty International, and Freedom House, all of whom have since called for his immediate release. Al-Hasany’s organization Sawasiyah, is considered one of the most important in-country monitors and defenders of human rights, and his detention is therefore a serious setback for those who depend on Sawasiyah for protection and a voice.
Other examples of Syria’s ongoing disregard for international human rights abound. This past July 4th, on a day which for Americans symbolizes the triumph of this country’s struggle for freedom and justice, Human Rights Watch issued a reminder that one year following the massacre of an untold number of inmates at Sednaya Prison—many of them presumably prisoners of conscience— by Syrian authorities, no one has been brought to justice. Syria has been allowed to bury these victims in ignominy alongside the regime’s own crimes against its people.

Madame Secretary, we have been hopeful since your confirmation as Secretary of State that you will stand in defense of human rights, particularly in the developing world. Your most recent comments during your visit to Africa insisting on political and legal reforms in countries like Nigeria and the Democratic Republic of the Congo were extremely encouraging. Yet, with regard to Syria, we have not seen any substantial progress as of yet.
The policy of political openness toward the Syrian regime was welcomed by Syrian activists because we hoped that openness would promote legal and political reform in the country and would go hand in hand with improvement in the conditions of human rights. However, arbitrary detention and imprisonment is still a way of life for all Syrian citizens. In fact, the most recent detention of Muhannad al-Hasany took place just three days after your special envoy, Mr. George Mitchell, left Syria.
While we understand the difficulties of negotiating a middle road in foreign policy, as human rights activists, we worry that the ideals which are fundamental to all peoples, and are particularly dear to the American people, will be sacrificed on the altar of American foreign policy. The people of the Middle East are watching carefully to see what steps you will take to make true the positive support President Obama pledged to human rights activists in his Cairo speech. We request that during this period of rapprochement with the Syrian regime, you demand Syria respects internationally mandated human rights and that you indicate to the regime openness is conditioned with the total and unconditional respect of human rights, the cancellation of the state of emergency and the disbanding of the Special and Military tribunals. We ask that you personally intervene to compel the release of Muhannad al-Hasany, and all other political prisoners and prisoners of conscience, as a first step by the regime to express its good intentions and seriousness toward political reform. The Syrian regime has a long history of broken promises, and we sincerely hope that their most recent gestures do not fall flat as they did in 2000 when Secretary Albright “congratulated” Bashar al-Asad’s seizure of power.

نتوجه اليك بهذا الكتاب تعبيراً عن بالغ القلق والأسى لما وصلت اليه حالة حقوق الإنسان المتدهورة في سوريا، وذلك ننتيجة ممارسات النظام المخالفة للقانون، والمنافية للدستور السوري، والمتناقضة مع الإعلان العالمي لحقوق الإنسان، والمتجاهلة للمعاهدات الدولية التي صادقت عليها سورية.
لقد شهدت سورية تدهوراً خطيرا في مجال حقوق الإنسان خلال الأشهر الستة الماضية، ليصل إلى مستويات لم يبلغها منذ أوائل الثمانينات من القرن الماضي. ونحن نلاحظ على أرض الواقع أزدياداً مستمراً في ممارسات الإضطهاد والقمع والاعتداء على حقوق الانسان الأساسية، وعلى المدافعين عن الحريات.
وكان آخرهذه الممارسات اعتقال رئيس المنظمة السورية لحقوق الإنسان (سواسية) المحامي مهند الحسني المعروف بدفاعه الجريء عن معتقلي الرأي، الذين يضطهدون بسبب التعبير عن آرائهم، والافصاح عن معارضتهم لنظام سورية الاستبدادي. وتعتبر تقارير الحسني عن الكثير من حالات الإضطهاد في سورية مرجعا لمنظمات دولية عدة نذكر منها (هيومان رايتس ووتش ومنظمة العفو الدولية وبيت الحرية). وقد طالبت كل من هذه المنظمات باطلاق سراحه الفوري، حيث ان اعتقاله نكسة كبيرة لحقوق الإنسان في سوريا، لكون المنظمة السورية لحقوق الإنسان (سواسية) التي يترأسها الحسني من أهم المنظمات المراقبة لحالة حقوق الإنسان في سوريا.
والأمثلة كثيرة عن انتهاكات النظام السوري وعن الوضع المزري لحقوق الإنسان في سورية.
ففي اليوم الرابع من شهر تموز/يوليو 2009، اليوم الذي يمثل انتصار الحرية والعدالة للشعب الأمريكي، اصدرت هيومان رايتس ووتش بياناً ذكرت فيه بأنه رغم مرور سنة على مذبحة سجن صيدنايا على يد السلطات السورية والتي ذهب ضحيتها عدد غير معروف من المساجين، أغلبهم من مساجين الرأي، فانه لم يقدم أحد للعدالة بعد. وتركت سورية تدفن ضحاياها بلوعة مع جرائم النظام ضد شعبه.
السيدة الوزيرة، لقد تفاءلنا خيراً بوصولك لمنصب وزيرة الخارجية في أميركا، ونحن نتابع مواقفك المدافعة عن حقوق الإنسان في العالم الثالث بشكل خاص، وكان آخرها تصريحاتك التي أطلقتيها أثناء زيارتك لإفريقيا والمطالبة بإصلاحات سياسية وحقوقية في دول مثل نيجريا والكونغو الديمقراطي، وقد انعكست تصريحاتك تفاؤلاً في نفوسنا.
لقد رحب النشطاء السوريون بسياسة الانفتاح مع سوريا، لأملهم بأن يترافق الانفتاح مع الإصلاحات السياسية والقضائية في البلاد، وأن يجري الانفتاح هذا بالتزامن مع تحسن ملف حقوق الإنسان، لكن الاعتقالات على أساس الرأي ما تزال تشكل كابوساً لكل المواطنين السوريين، وجاء آخرها اعتقال السيد مهند الحسني بعد ثلاثة أيام من زيارة مبعوثكم السيد جورج ميشيل لسوريا.
في الوقت الذي نتفهم صعوبة السير في طريق متوازنة في السياسة الخارجية؛ فإننا كناشطين من أجل حقوق الإنسان قلقون من أن تتم التضحية بالمثل الإنسانية العليا التي هي جوهرية لكل الشعوب، ولا سيما للشعب الأمريكي، على مذبح السياسة الخارجية الأمريكية. وشعوب الشرق الأوسط تراقب معنا لترى الخطوات التي ستقدمون عليها لتحولوا التزام الرئيس أوباما تجاه مناضلي حقوق الإنسان الذي أعلنه في خطابه في القاهرة إلى واقع قائم.
لذلك نطلب منكم، خلال مدة التقارب مع النظام السوري، أن تطالبوا النظام في سوريا باحترام حقوق الإنسان المعترف بها دوليا. وأن تطرحوا على النظام إنفتاحا مشروطا باحترام كامل لحقوق الإنسان وإلغاء حالة الطوارئ والمحاكمات العسكرية والإستثنائية. ونطالب أن تتدخلوا شخصيا لإلزام النظام إطلاق سراح الإستاذ الحسني ومعتقلي الرأي والضمير أمثال قيادات إعلان دمشق وغيرهم كخطوة أولى من النظام للتعبير عن حسن نيته وجديته في الإصلاح السياسي.
السيدة الوزيرة، إن تاريخ النظام السوري مليء بالوعودة الكاذبة، ونأمل أن لا تلق وعوده الجديدة لكم المصير نفسه الذي انتهت فيه وعوده السابقة، ولاسيما تلك التي وعد بها عام 2000 عندما "باركت" السيدة أولبرايت وصول بشار الاسد الى سدة الحكم.

ونبقى دوما تحت تصرفكم من أجل أي معلومات اضافية تحتاجونها خدمة لشعبنا وحريته وكرامته، وتقبلي منا فائق الاحترام.
