نحن الموقعون أدناه نعبر عن رفضنا للقرار الظالم الصادر عن المحكمة الجنائية الكبرى برئاسة القاضي الشيخ محمد بن علي آل خليفة في 16 سبتمبر/ أيلول2009 بالحكم بثلاث سنوات سجن على المواطن البحريني حسن سلمان بتهمة تسريب معلومات خاصة بجهاز الامن الوطني، وهو الجهاز المسئول عن التعذيب والانتهاكات الواسعة لحقوق الانسان خلال الثلاثين سنة الماضية، ومن ضمن ذلك الاستخدام المفرط للقوة والاحتجاز التعسفي، والتعذيب الواسع والممنهج بما فيه التحرشات الجنسية، والقتل خارج نطاق القضاء.
تجدر الإشارة إلى أن النيابة العامة رفضت تمكين السيد حافظ حافظ -محامي حسن سلمان- من الحصول مستندات ووثائق الدعوة، والتي اعتمدت عليها المحكمة في حكمها، كما لم تقدم النيابة العامة تلك المستندات أو الأسماء المنشورة إلى المحكمة. وكانت أجهزة التحقيق قد حاولت مساومة حسن سلمان مقابل الإفراج عنه، وذلك من خلال طلب زج أسماء بعض النشطاء الحقوقيين في نفس القضية وتوريطهم بتهمة تحريضه وتمويله في نشر تلك الأسماء، إلا انه نفي التهمة من الأساس ورفض إطلاق سراحه مقابل الزج بأسماء أناس لا دخل لهم بالقضية. ومن بين تلك الأسماء التي حاولت الأجهزة الأمنية الزج بها نبيل رجب -رئيس مركز البحرين لحقوق الانسان- والسيدة ليلى دشتى- المشرفة بموقع ملتقى البحرين الإلكتروني، وهو الموقع الذي كان له السبق في نشر الأسماء لأول مرة.
وعلق نبيل رجب – رئيس مركز البحرين لحقوق الإنسان على صدور الحكم قائلا ” أن الحكم بسجن شاب في مقتبل العمر لثلاث سنوات بتهمة نشره أسماء موظفين حكوميين يوضح الخزي والعار الذي يشعر به العاملون بهذا الجهاز، وخوفهم من انكشاف أمرهم لعامة الناس، وذلك لمسئولية هذا الجهاز عن الانتهاكات الواسعة لحقوق الانسان، منذ لحظة تأسيسه -تحت مسمى جهاز امن الدولة- وحتى تغيير اسمه لجهاز الأمن الوطني. وأضاف رجب: ” هذا الجهاز هو المسئول عن قتل الأبرياء خارج نطاق القضاء وهو المسئول عن التعذيب المنظم وإساءة معاملة المعتقلين والسجناء، والمتورط في الاعتداءات الجسدية والجنسية بحق مئات المعتقلين، والمشرف على عمليات الاعتقال والاحتجاز التعسفي. ونتيجة لكل ذلك أصبحت عناصر ومسئولي هذا الجهاز تعمل بالخفاء خشية انكشاف ارتباطها بهذا الجهاز سيئ الصيت. وإننا قد حذرنا في أكثر من مناسبة في أن الاستمرار في تمكين وتدعيم دور وصلاحيات ومساحة نفوذ هذا الجهاز المنفلت والذي عاث في البلاد فساد في السنوات الأخيرة، وخلق وضعا شبيها لما عرف به جهاز “السافاك” الإيراني الذي تسبب في انتهاكات واسعة لحقوق الإنسان في إيران أبان عهد الشاه، وكان سببا رئيسيا في انتقادات دولية واسعة لها وهيئ للثورة الشعبية التي أنهت حكم الشاه عام 1979″.

نحن الموقعون على هذه العريضة الالكترونية نطالب السلطات البحرينية بإطلاق سراح الشاب حسن سلمان فورا ودون شروط لعدم قيامه بأي جرم يستحق الاعتقال أو المحاكمة.

We, the undersigned express our rejection of the unjust decision of the Higher Criminal Court headed by Judge Shaikh Mohammed bin Ali Al Khalifa, on 16 September 2009 Governing three years in jail for the Bahraini citizen Hassan Salman on charges of leaking names of National Security Apparatus (NSA) employees, the body responsible for the torture and massive violations of human rights violations during the last thirty years, and within that the excessive use of force and arbitrary detention, and the widespread and systematic torture, including sexual harassment and extrajudicial killings.

It should be noted that the General prosecution refused to allow for Mr. Hafez Hafez - lawyer, Hassan Salman - to obtain documents of the case, which was adopted by the Court in its ruling, and prosecutors did not provide such documents or the published information to the court. The investigative organs have tried bargaining Hassan Salman for his release, and by the requests of involving some of human rights activists on charges of inciting and funding to publish of NSA information, but Hasan denied the charge from the ground and refused to release himself in return for the involvement of the names of people who have nothing to do with the case. Among those activists that the security services tried to drag is Nabeel Rajab - Chairman of the Bahrain Center for Human Rights - Ms. Layla Dashti - which oversees the location of Bahrain online forums, a site that had a lead in publishing the names for the first time.

Commented Nabeel Rajab - Chairman of the Bahrain Center for Human Rights to the verdict, saying that "the imprisonment of a young man to three years for publication the names of government officials shows the shame and stigma felt by workers in this apparatus, and their fear of exposure to the general public, due to the responsibility of that apparatus of massive violations of human rights, from the moment of its foundation - under the name of the state security service - and even change the name to the National Security Service. This apparatus is responsible for the killing of innocent people outside the judiciary and it is responsible for systematic torture and ill-treatment of detainees and prisoners, and was involved in physical and sexual abuse of hundreds of detainees, and the supervisor of the arrests and arbitrary detention. As a result, the workers of this apparatus are working in secret for fear of exposure linked to this apparatus notorious. We have been warning in more than one occasion to continue to empower and strengthen the role and powers of the area of influence of this apparatus and uncontrolled in the country ravaged by corruption in recent years, and create a situation similar to what is known by the "SAVAK" Iran, which resulted in massive violations of human rights in Iran during Under the Shah, was a major cause of widespread international criticism and prepared them for the popular revolt that ended the rule of the Shah in 1979. "

We are signatories to this petition call on the authorities to release the young Bahraini Hassan Salman immediately and without conditions for not doing any offense worthy of arrest or trial.
