Wie is Harry Bout?

Harry Bout (Zeist, 1958) is als kind met zijn ouders verhuisd naar Michigan (Verenigde Staten). Harry heeft altijd zijn Nederlandse nationaliteit behouden, en hij heeft zich altijd een Nederlander gevoeld. Zijn ouders spraken thuis in Michigan Nederlands. Er werd ook veel Hollandse (en Indische) pot op tafel gezet en de Nederlandse cultuur werd doorgegeven. Harry, ver van huis opgesloten, is lang een vergeten Nederlander geweest.

In 1985 is Harry veroordeeld tot een levenslange gevangenisstraf zonder kans op vervroegde vrijlating voor een moord die hij niet heeft kunnen plegen.
Er is een getuige, maar tijdens het ‘gerechtelijk’ onderzoek verandert de politie het bewijs, zodat de officier van justitie de jury kan overtuigen dat deze hem moet geloven en niet Harry en zijn getuige. De getuigenis wordt door de rechter afgedaan als ongeloofwaardig, omdat deze niet strookt met de versie van de politie. De advocaat, Mr James Sterling Lawrence, heeft later de bewijzen tevoorschijn weten te halen maar de rechter staat ze niet toe in de rechtzaak. Schending van internationaal verdrag: de Weense Conventie

Na zijn arrestatie mag Harry zijn consulaat niet op de hoogte brengen en vragen om bijstand. Hiermee schenden de Verenigde Staten het Verdrag van Wenen, waarin staat dat buitenlandse ingezetenen recht hebben op bijstand van hun consulaat als ze gevangengenomen worden in het buitenland.

Wat willen de ondertekenaars van deze petitie bereiken?

Wij willen dat Harry terugkeert naar zijn eigen land, bijvoorbeeld door middel van het WOTS-verdrag. Het ministerie van Buitenlandse Zaken heeft hier een belangrijke functie in. Het ministerie zou in gesprek moeten met de staat Michigan om Harry terug naar Nederland te krijgen. Mr. G.G.J. Knoops staat Harry bij met de WOTS-procedure.

Waarom?

Harry Bout zit voor een moord die hij niet gepleegd heeft, en er zijn meer fouten gemaakt tijdens de rechtzaak. 21 jaar zit hij al vast, terwijl de echte moordenaar vrij rondloopt. Zelfs als men gelooft dat hij vastzit voor waar hij schuldig aan verklaard is, zou Michigan na 21 jaar de geboden gastvrijheid kunnen overdragen aan Harry’s eigen land, waar hij zelfs in gevangenschap in de VS nog stemrecht heeft.

WOTS-aanvraag tot terugkeer: Harry’s familie in Nederland wil hem terug

Harry heeft familie in Nederland die achter hem staat. Wanneer Harry terug kan keren naar Nederland dan kan hij tenminste wat verloren tijd compenseren met hen. Zij willen hem ook ondersteunen als hij in Nederland is. Mensen om hem heen zijn hem ontvallen zonder dat hij afscheid van ze heeft kunnen nemen.

Door alle stress die voortkomt uit het onrecht dat hem aangedaan is en door het gevangenisleven gaat het niet goed met Harry’s gezondheid. We moeten niet te lang wachten: het kan toch niet dat we dadelijk niet moeten zeggen: We zijn te laat!

Who is Harry Bout?

Harry Bout (Zeist, 1958) moved to the United States with his parents when he was two years old. He has always maintained his Dutch nationality, and he has always felt he is a Dutch citizen. His parents used Dutch language at home and they always had Dutch food and Dutch culture in the house. Harry has since long been a forgotten Dutchman, locked up far away from home.

In 1985 Harry Bout was arrested and condemned to Life Without Parole for a murder he could not have committed. There is a witness, but during the investigation, the police change the evidence, thus the prosecutor could convince the jury to believe them rather than the defendant. The testimony of the witness is then discarded by the judge.
Harry Bout’s attorney, Mr James Sterling Lawrence, later on manages to retrieve evidence and witness accounts, but the judge does not allow the photo evidence in the motion for appeal. The evidence can be seen on freeharrybout.org, the site of the Supportgroup.

Violation of International Treaty: the Vienna Convention

After being arrested, Harry Bout was not allowed to contact his consulate to ask for assistance. In denying this, the United States of America violate the Treaty of Vienna, in which is stated that foreign inhabitants are entitled to assistance of their consulate when arrested in a foreign country.

What do the undersigned of this petition want to achieve?

To bring Harry Bout back to The Netherlands, his native country
What we want is that Harry is returned to his own country, by way of the “WOTS”-deportation agreements for example. The Ministry of Foreign Affairs plays an important role in accomplishing this: it should enter into discussion with the State of Michigan in order to have Harry returned. Attorney G.G.J. Knoops represents Harry with the WOTS-procedure.

Why?

Harry Bout is being punished for a murder he did not commit, and a lot more mistakes have been made during the trial. He has been in prison for more than 21 years, while the real murderer is still on the loose. Even if one does believe that he is detained for what he has been charged with, it is high time that Michigan hand over the “hospitality” offered in a prison cell to Harry’s home country, relieving US taxpayers. Harry even has voting rights in The Netherlands!

WOTS-deportation back home: Harry’s family wants him back!

Harry’s family in The Netherlands supports him too. On his return to The Netherlands he can at least make up lost time with his relatives here. They will also support him in The Netherlands. Several family members of Harry have died since he was in prison, and he never got the time to say goodbye to them.

Please note that Harry’s health is not the very best, due to the amount of stress suffered because of the injustice created in the trial and the appeals afterwards, and because of prison life. We hope to attain Harry’s return on time. We do not want to be sorry for not acting sooner.
