San Diego City Council; Impeach Bush & Cheney

To:  San Diego City Council

To the members of the San Diego City Council in particular & the entire San Diego community in general,

On behalf of the Impeachment Committee of San Diego (ICSD) & the citizens of the City of San Diego listed below, who have signed the enclosed petition, we call on the San Diego City Council to follow a genuinely democratic path & truly represent San Diego’s vote for accountability & justice by immediately passing a resolution calling for:

THE IMPEACHMENT OF PRESIDENT GEORGE W. BUSH & VICE PRESIDENT RICHARD B. CHENEY.

We are convinced of the absolute validity of this legal & political course of action as it serves both justice & government accountability to the people. It also serves as a democratic indicator for the lack of popular support for the current U.S. occupation of Iraq, & specifically the national leadership that drove us into this illegal & unjust war & keeps us stuck in this endless cycle of U.S.- sponsored aggression & terror.

WHEREAS, George W. Bush & Richard B. Cheney conspired with others to defraud the U.S. by intentionally lying to Congress & the public re: an alleged threat from Iraq in order to justify a war in violation of Title 18 US Code, Section 371; &

WHEREAS, George W. Bush has admitted to ordering the National Security Agency to conduct electronic surveillance of U.S. civilians without seeking warrants from the Foreign Intelligence Surveillance Court of Review, duly constituted by Congress in 1978, in violation of Title 50 US Code, Section 1805; &

WHEREAS, George W. Bush & Richard B. Cheney conspired to commit the torture of prisoners in violation of the “Federal Torture Act” Title 18 US Code, Section 113C, the UN Torture Convention & the Geneva Convention, which under Article VI of the U.S. Constitution are part of the “Supreme Law of the Land”; &

WHEREAS, George W. Bush & Richard B. Cheney acted to strip U.S. citizens of their constitutional rights by ordering indefinite detention without access to legal counsel, without charge & without the opportunity to appear before a civil judicial officer to challenge the detention, based solely on the discretionary designation by the President of a U.S. citizen as an “enemy combatant”, all in subversion of law; &

WHEREAS, In all of this George W. Bush & Richard B. Cheney have acted in a manner contrary to their trust as Pres. & Vice Pres., subversive of constitutional government to the great prejudice of the cause of law & justice, & to the manifest injury of the people of San Diego, CA & of the U.S.; &

WHEREAS, Many thousands of people of several countries have been unnecessarily killed and maimed; &

WHEREAS, Hundreds of billions of dollars have been wasted while human necessities in San Diego and across the U.S. have been cut back; &

WHEREAS, Petitions from the country at large may be presented by the Speaker of the House according to Clause 3 of House Rule XII;

Be it resolved that George W. Bush & Richard B. Cheney, by such conduct, warrant impeachment & trial, & removal from office & disqualification to hold & enjoy any office of honor, trust or profit under the U.S., plus the consequence of prison terms relevant to the gravity of their crimes;

Be it resolved further by the City of San Diego, that our senators & representatives in the U.S. Congress be, & they are hereby, requested to cause to be instituted in the Congress of the U.S. proper proceedings for the investigation of the activities of George W. Bush & Richard B. Cheney, to the end that they may be impeached & removed from such office & imprisoned with the due process entitled to them as well as any other indicted person in the U.S..

Be it resolved further, that the Clerk of the City of San Diego be, & is hereby, instructed to certify to the Speaker of the House of Representatives, under the seal of the City of San Diego, a copy of this resolution & its adoption by the City of San Diego, as a petition, & request that this petition be delivered to the Office of the Clerk & entered in the US Congressional Journal. The copies shall be marked with the word “Petition” at the top of the document & contain the original authorizing signature of the Clerk of San Diego.
