India is a democracy which grants equal rights to all its citizens with commitment to protect the minorities. In our bid to protect minorities, we have forgotten the minority among minorities, i.e., muslim women.
They are daughters of this country and therefore entitled to all the protection that our constitution provides to the daughters of this country. Currently, they are being discriminated against by the virtue of Muslim Personal Law. As per Muslim Personal Law, the muslim women in India are governed by Shariat Law. This law deprives muslim women of the right to not share their husband, right to get married only after 18 years of age, right to equality in marriage and right to have maintenance after divorce. This also deprives the muslim women of protection from whimsical divorce.
This has led to an unprecedented situation where a minority (muslim woman) is being persecuted by another minority (muslim man). This is against the spirit of constitution.
We appeal to you to revoke the Muslim Personal Law and bring all the civil matters related to marriage and other with the exception of cultural rites connected with birth, marriage and death under the purview of a Uniform Civil Code which should be modeled on Hindu Marriage Act as that provides maximum protection to women. While doing so, if the Hindu Marriage Act can also be modified to provide more protection then the same should be done and all the personal laws like Hindu Marriage Act, Muslim Personal Law should be declared null and void as in a secular state, no religion based personal law should be allowed.
