2003 FEDERAL JUDICIAL MISCONDUCT PETITION |
To: U.S. CONGRESS2003 REVIEW OF FEDERAL JUDGE MISCONDUCT AND 28 U.S.C 372( c) COMPLAINTS
I am a voter/citizen of the United States and I do not believe the current review of Federal Judge conduct as described in 28 U.S.C 372(c) provides an independent, unbiased assessment of alleged judicial misconduct. I believe a grand jury or independent authority, which is not connected with the judicial branch of the government, should review judicial misconduct.
I believe judicial misconduct complaints should be reviewed in a public forum and the results made a public record.
I believe all 28 U.S.C. 372( c) complaints filed after January 1, 1999 should be reviewed by the proposed independent review procedure and commented on as to why the complaint was without merit. I believe Federal Judges who have committed gross judicial misconduct must be found to have exceeded their scope of authority and be held personally accountable for their actions. Gross judicial misconduct is the judicial failure to abide by the Federal Rules of Civil/Criminal Procedure, Federal Rules of Appellate Procedure, Canons of the Code of Judicial Conduct, adhere to stated standards of review when issuing an order and failure to state why on point case law is not relevant when reaching a conclusion.
