A New Trial or Clemency for Margo Freshwater (Tonya Hudkins McCartor)

UPDATE!!! As of Oct 2nd we gave oral arguments to the appelet court. We expect a opinion by the end of this year for getting a new trial.

To:  Governor of the State of Tennessee

This Petition is put forth for granting a New Trial, Executive Clemency or commuting the 99 year sentence of Margo Freshwater (Tonya Hudkins McCartor). This petition is based on these facts.

A. Grounds of newly discovered evidence.

1. Trial level constitutional violations have become evident

a. Information crucial to her defense was withheld from her defense attorney by the state.

b. The Jury was given extraneous prejudicial information from Newspaper and TV.

B. She has proven she is not a threat to society.

C. For 32 years she led a respectable life contributing to society. Maintained a 20-year career with Metropolitan Life.

D. Raised a family, all of whom are productive members of society.

E. She had no criminal history, prior to the charge for which was convicted.

F. She was an innocent victim of circumstances beyond her control.
