Microsoft Software Patents are Unconstitutional

Microsoft since its beginning has been trying to take the freedom of Americans away when it comes to computing for their own financial gain. It is my opinion that patenting any software is Unconstitutional and needs to be stopped. Here is my reasoning on this. Computing in general is done by the exact same processes across all architectures. It does not matter if its IBM compatible or Apple Macintosh systems. They all adhere to the same processes for developing software for those computing systems. If we continue to let these software development corporations patent how a computer can be programmed then that is taking away our freedom as Americans to choose what software to put on our own computers and computing devices that we own. Once you own something you can pretty much do whatever you want with it within the law.
Software is written just like novels and other books are. They should only be on copyright laws and not able to have patents on them. If I want to make software that has the ability to create a document that I write Microsoft can legally right now sue me or license me so that I would have to pay to make that software. Because it looks too much like their Microsoft Word application.
Same thing goes for Linux. It is too much like Microsoft Windows so they are trying to get rid of it. This is all a ploy to take away our freedom to choose what we can have on our computers without the need to pay them money for it. Even though the code itself is nowhere near the code that is used to make Microsoft Windows.
No one should be able to patent code or the way software looks or how it operates. As long as the code is not copied directly since this would be prohibited by copyright law. Then I or anyone should be able to write or install software or any operating system that we want to on our computers that we bought with our own hard earned money.
There is currently a law suit going on where Microsoft is suing Tom Tom because of the software they use is too close looking and acting to what they have a patent on. I agree with patenting hardware and circuits that are made a specific way because it is an invention. But that's hardware and not software.
