Petition to decriminalize same-sex practices in Cameroon
Article 347 bis of the Penal Code criminalizes consensual same-sex practices as follows: "shall be punished by imprisonment of six months to five years and a fine of 20,000 to 200,000 CFA francs (from 30 to 300 Euros or 40 to 400 US Dollars) a person who has sexual relations with a person of the same sex. "
We the undersigned ask the Government of Cameroon to abolish Article 347 bis for the following reasons:
This article is used to condemn sexual relations between consenting adults of the same sex in a private setting. This violates their rights to privacy and nondiscrimination protected by the Constitution of Cameroon and by international human rights treaties ratified by Cameroon.
This article is used to arbitrarily criminalize homosexual identity, thus many people are arrested and imprisoned for alleged homosexual conduct on the simple basis of denunciations.
This article institutionalizes intolerance and homophobia, depriving the alleged homosexual persons the right to health, education, work, security and justice.
Cameroon is a currently a member State of the Human Rights Council of the United Nations. This imposes and additional responsibility on this State to respect the international consensus on human rights, including guaranteeing equality and non discrimination on the grounds of sexual orientation and gender identity.
This article was introduced in 1972 by an order of President Ahmadou Ahidjo through a process that was not democratic and participatory.

Petition pour la depenalisation des rapports homosexuels au Cameroun

Larticle 347 bis du Code Penal criminalise lacte sexuel entre deux personnes de meme sexe : Est punie dun emprisonnement de six mois а cinq ans et dune amende de 20.000 а 200.000 francs toute personne qui a des rapports sexuels avec une personne de son sexe.
Nous soussignes, citoyens camerounais, demandons au Gouvernement camerounais dabolir larticle 347 bis pour les raisons suivantes :
Cet article est utilise pour condamner les relations sexuelles entre adultes consentants du meme sexe dans un cadre prive ; cela viole leurs droits а la vie privee et а la non-discrimination proteges par la Constitution camerounaise et par les traites internationaux ratifies par lEtat camerounais.
Cet article etait utilise arbitrairement pour penaliser lidentite homosexuelle ; de nombreux citoyens etaient arretes puis emprisonnes pour leur supposee homosexualite sur la simple base de denonciations.
Cet article institutionnalise lintolerance et lhomophobie ; ce qui prive les personnes pretendues homosexuelles de droit а la sante, а leducation, au travail, а la securite et а la justice.
Le Cameroun est un Etat membre du Conseil des droits de lHomme de lONU ; en cette qualite, il doit respecter le consensus international sur les droits de lHomme, incluant les questions de relations entre personnes de meme sexe.
