This petition is to support the passage of New Jersey General Assembly Bill No. 690 of the 211th State Legislature. The bill was introduced by Assemblymen Robert J. Smith and John J. Burzichelli.
The purpose of the bill is to amend Title 2A:154-5 of the New Jersey Code in regards to Federal Law Enforcement Officers adding federal police officers from the Department of Defense Police. Currently the title states the following:
1. The following persons employed as full-time law enforcement officers by the Federal Government, who are empowered to effect an arrest with or without warrant for violations of the United States Code and who are authorized to carry firearms in the performance of their duites, shall be empowered to act as an officer for the arrest of offenders against the laws of this State where the person reasonably believes that a crime of the first, second or third degree is or is about to be committed or attempted in his presence:
Federal Bureau of Investigation special agents; United States Secret Service special agents; Immigration and Naturalization Service special agents, investigator and patrol officers; United States Marshal Service deputies; Drug Enforcement Administration special agents; United States Postal Inspectors; United States Postal police officers while in the performace of their official duties; United States Customs Service special agents, inspectors and patrol officers, United States General Services Administration special agents; United States Department of Agriculutre special agents; Internal Revenue Service special agents and inspectors; and Department of the Interior special agents, investigators, park police and park rangers.
The Department of Defense Police was overlooked in the title. The DOD Police are federal police officers and detectives that provide law enforcement services for federal property and military installations located in the State of New Jersey. Fort Dix, Fort Monmouth and Lakehurst Naval Station are just to name a few. The police officers fit the criteria of the title in that they are employed full time by their agency, carry firearms and are empowered to affect an arrest with or without warrant for violations of the United States Code.
The DOD Police already enforce and make arrests for violations of New Jersey Statutes that occur on federal property. They make arrests for DUI, Title 39 traffic violations, domestic violence, narcotics and other Title 2C crimes. They also support the local law enforcement agencies that operate in the areas surrounding their jurisdiction.
All federal police officers attend an accredited and certified law enforcement academy at the state, county or federal level. They have the same enforcement duties and responsibilities as the agencies already specified in the title. They equally place their lives on the line in the performance of their duties to protect the citizens of this state and country.
