Abolish the Homeowners Associations

We, the undersigned, are citizens who believe that the privilege to maintain their own property should be restored to the property owners without interference by the arrogant and abusive Homeowners Associations (HOA) and the threat of lien on the homeowners property to collect fees, fines or assessments that may lead to home foreclosure.

The major concerns are abuse of power and the worsening economy. Homeowners Associations have too much power with a lot of oversights. Some states do not demand true financial accountability by the associations. Should there be a disagreement and the case is brought to trial, some states require the homeowner to pay for the HOA attorneys fee win or lose, which is just a nice way of intimidating the poor homeowner from filing a lawsuit.

Some states have granted power to HOA in which they can seize a home through foreclosure in order to force payment of homeowner assessments, no matter how small. HOA may be violating the constitutionally guaranteed rights of due process when it forecloses on a Common Interest Development (CID) home. Homeowner citizens should not be deprived of liberty or property, without speedy due process of law. The Homeowners Associations have foreclosed hundreds of properties across the United States for not paying a few hundred dollars of delinquent dues. The punishment does not fit the misdemeanor.

We, the homeowners, already have a lot of problems in these hard times. By eliminating the HOA monthly dues that range from ten dollars to several hundreds, it removes one variable in the economic equation. It may sound small, but to ordinary workers, and worst, to thousands of jobless Americans with no immediate aids in sight, that is a big relief.

We request that the State Legislators act quickly to abolish the Homeowners Associations in their respective states to alleviate the deeepening financial problem of Americas homeowners.

    • It's offensive that I'm not considered legal trustee of my own property. Rather I have the "privilege" of paying a fee, under threat of lean, to be a caretaker of the HOA's property. Of which also I pay the mortgage and property tax. HOA's should be illegal.

    • In my experience, HOA's have caused more harm than they have ever done good for their communities. I have never had legal issues with any HOA, but I have known many neighbors who have. Most of the people on these boards are people who can't get any respect any other way than to wield this pathetic little power over their neighbors. The answer to community issues isn't yet another pseudo-administrative, pseudo-police organization like HOAs--it's getting to know one's neighbors and actually HAVING a COMMUNITY to care about. HOA, by its very definition, thwarts that dynamic. It's time for them to end.

    • the subdivision i have lived in for over 2 years without an hoa has just started one. we have no common area, pool, tennis court, lawn care, etc., anything that would have some sort of "dues" to be paid for using.

    • We are federally, state, county, and city goverened. Why do we want to bring this to our own neighborhoods. It is time to go back to basics and stop trying to control every little thing. Most importantly HOA's who do not follow through with their purpose is just a waste of money for dedicated familys who work hard just to pay their own bills. HOA's are unconstitutional and more most of all used by control freak neighbors to control their neighbors. They need to me abolished for so many reasons.
