In May 2005, Ambrose R. Hawk was falsely convicted of a crime he did not commit, His attorney failed to present known evidence that would prove his innocence. Therefore, his conviction was based upon the jury not having all the facts needed to make a judgment.We strongly feel with the new physical evidence and at least 10 new witnesses that are available to testify to the false allegations would give Mr. Hawk a fair trial.

Mr. Hawk has been charged with lewd conduct of a minor over the age of 14. In a she said he said case, there is no physical evidence or DNA against him. The first trial was strictly a she said case. In the alleged victims claim, she states they had an ongoing consensual sexual relationship for over a year in his home, where his wife and foster children were always present. She stated that they would have sex right under the noses of everyone and no one paid any attention. One instance she claims his wife was asleep in the bed and they had sex right next to her and she never work up.

The evidence that was not presented at the first trial includes actual receipts from a naval base, proving he was in another part of the state during one of the alleged incidents. An ex-wife who can testify to his sexual habits and the distinguishing marks on his penis, which the alleged victim said did not exist. His current wife can also verify this information. There are also witnesses who can verify that the alleged victims witness has filed numerous false abuse claims against other people when she was angry at them. Finally, Mr. Hawks first attorney refused to allow him to testify on his own behalf during the trial, even though it is Constitutional right to do so.

We are asking that the court grant Mr. Hawks motion for a new trial based on the new evidence and allow him the chance to prove his innocence.

We the undersigned agree that in light of the evidence not presented during Ambrose Hawks first trial a gross miscarriage of justice was committed, and we urge the court to grant his motion for a new trial, based on the incompetence of his council during the first trial.

We, the undersigned, urge a review and investigation of the new witnesses, as well as the physical evidence not presented, and its effect upon the trial, as well as the circumstances that allowed such a flagrant incompetence of counsel to continue through the length of the first trial

We, the undersigned, urge a the courts to grant Mr. Hawks motion for a new trial quickly in order for him to receive a fair trail that all Americans are afforded under the Constitution of the United States. We urge this in order to restore the publics confidence in the United States Legal System.

    • A trial where all witnesses and evidence is not permitted is not a fair trial. If Hawk's own lawyer was the one that withheld the witnesses or evidence, he should be disbarred! Give this man a fair trial.

    • As a long time friend of Mr. Hawk I find the charges for which he is wrongly convicted of astonishing that the judicial system let this miscarriage of justice occur. A new trial with competent counsel and all facts presented is necessary to uphold the freedoms this country holds dear.

    • AS this court may be aware,a he said and she said without the proper evidence is like having no evidence at all and the case should have been dismissed.If there was evidence to support the testimony,let the verdict stand as is however,if there is more evidence on the side of the defendant backing his testimony,grant a new trial, a lack of dna should have the courts alarm button sounding in that this may be a mere case of "crying wolf".I am a paralegal student in Massachusetts
