Facts
The First and Second Defendants published drawings insulting Prophet Muhammad in 2006. This publication was followed by an apology by the Danish Government to the Muslim Nation. However, the cartoons defaming Prophet Muhammad (Gods Peace and Blessing Be Upon Him) were reprinted in 2008 in many newspapers in the same country.
Whereas this behavior forms a defamation of the honorable Prophet Muhammad and results in a grave insult to the Muslim Nation as a whole; and whereas this issue has caused us great physical and psychological harm; and in implementation of the Tradition of Prophet Muhammad (Gods Peace and Blessing Be Upon Him): There should be neither harming nor reciprocal harming. This tradition makes it clear that Prophet Muhammad, the harmed person in this lawsuit, mentioned to us more than 1430 year ago a very important principle of the international community principles. It is one of the United Nations and human rights organizations principles and charters, which are being established in the developed and developing communities. The honorable Prophet called for this principle of avoiding reciprocal harming of the humans. For Gods sake, how could these developed communities and human rights organization calling for such principles accept such insults, excesses and aggression on the freedom of belief? None of them has ever given any condemnation, denial or reaction, usually given when a president, public figure or a holy man is insulted. What would you think about those who insulted and defamed the Master of humanity and Gods Messenger? He is the Prophet and leader of the Muslim community who (does not speak out of desire). What did Prophet Muhammad do in order to be insulted by those people, who neither respect prophets, fear God, nor respect the freedom of religion or belief? They insulted the most pure human being. He called for nothing but righteousness and virtue. Neither did he call for vice nor anything prohibited by God. In fact, he called for worshiping God, the One and the Only. He guided people to everything that leads to reformation and prohibited them against everything that causes harm to them. The modern sciences and researches proved the Scientific Miracles in the Holy Quran revealed by God to His Messenger Muhammad (Gods Peace and Blessing Be Upon Him) and in the Prophets Traditions which explained the meanings of the Holy Qur'an. There are many examples to this. We leave these issues to scientists to prove and talk about.
Your Excellency, the Defendants have done great harm to us and caused us to feel deep sorrow, grief and bitterness. What did Prophet Muhammad (Gods Peace and Blessing Be Upon Him) did to them so that they would insult him. God, almighty, said in the Holy Quran If you will not aid him, God certainly aided him." Whereas, the purpose of this complaint against the second Defendant is to have a judgment passed against him so that he would be a proof against the Danish government.
Therefore,
First: We hereby submit this lawsuit to our Lord and most surely our Lord will judge between them on the day of Resurrection concerning that about which they differed.
Second: We hereby submit this lawsuit to the honored panel of the court, which is responsible for administering justice among people demanding that you would pass a judgment to the following effect:
1. a rehabilitation of Prophet Muhammad (Gods Peace and Blessing Be Upon Him), the prophet and leader of the Muslim Nation;
2. compelling the Defendant to apologize to all the Muslim world;
3. punishing the Defendants with a deterrent punishment, as deemed appropriate by your Excellency, so that such a defaming action would not be repeated in the future and so that they would be an example for third parties;
4. punishing the newspaper which reprinted such defaming cartoons, after the manner where the newspapers defaming country presidents and public figures are punished;
5. having a judgment passed against the Second Defendant so that it would be a proof against the Danish government.
In so doing, we adhere to the charters of the United Nations and the Principles of the human rights organizations (Article 29, Paragraphs 1, 2 and 3) of the Universal Declaration of Human Rights 1948-1998.
Your Excellency, the judges and jurists, we have resorted to the international legitimate channels as directed by our religion brought to us by our Messenger Muhammad (Gods Peace and Blessing Be Upon Him). Prophet Muhammad (Gods Peace and Blessing Be Upon Him) directed and recommended us to resort only to such a legitimate course, i.e. to obey the directions of God, Prophet Muhammad and rulers. Our religion ordered us also to have recourse to people in charge. Here we are complaining to your good persons.
Therefore, we appeal to your Excellency to administer justice, which is the basis of sovereignty. Justice is a Holy Attribute of God. We hope that you meet your abovementioned demands, which are the simplest rights of our honorable Prophet. Are not we humans just as the rest of humans who deserve protection from such human rights organizations. We wonder if those organizations are double weighting. If so, we surrender to God's well as we have neither power nor strength except with God's support and aid.
