Concerned Citizens for Motorcycle Safety (CCMS) - NY
New York City Targeting Motorcyclists for Noise and Revenue
An unprecedented bill virtually de-legalizing tens of thousands of otherwise legal, registered, insured and environmentally friendly motorcycles. We ask that New York City council members exercise other non-discriminatory options for raising revenue. Attempting to lesson noise and alleviate traffic congestion in New York City should not include a virtual ban on motorcycles as is the case if this bill is passed.
Manhattan, New York, December 21, 2008 Intro. 416-A, A Local Law to amend the administrative code of the city of New York, in relation to prohibiting the stopping, standing, or parking of motorcycles equipped with straight pipes on the streets of the city of New York.
This bill would deem tens of thousands of already legally registered motorcycles illegal, subject to enormous fines and permanent forfeiture of the motorcycle. We implore all New York City council members to reject this one-sided and biased bill targeting only motorcycles owned by citizens who are otherwise law abiding, tax paying voters.
The bill is aimed at noisy motorcycles with straight pipes or ones that knowingly remove or modify exhaust baffling. As we are in agreement with the objection of excessively noisy exhaust pipes, we believe the subject requires more insight and definition. We welcome the introduction of a panel that involves, but not limited to, representatives of the Environmental Protection Agency (EPA), the American Motorcyclist Association (AMA) and exhaust system manufacturers to hash out an environmentally conscious solution.
Amidst the expected budget cuts facing New York State in this unpredictable economy and undoubtedly looming over New York City , the NYC Council should remain steadfast in protecting the rights of its tax paying citizens. Lets not create an environment of chaos and further burden a police department clearly out of their realm.
Officials backing this bill apparently believe that requiring motorcyclists to have EPA-approved exhaust systems is easier to enforce than trying to prove a motorcycle exceeds the city's vaguely defined 80-decibel sound limit. - AMA Press Release 2008

- the penalties for violators are way to extreme. we need to be heard while riding our motorcycles because people drive their cars with stereos on, air conditioning on, talking on cell phones (hands free or otherwise).

- Our pipes are our voices, so to speak. It's the key way for motorists to be aware of our presence on the road. Banning them would be deterimental and unsafe to motorcyclists and motorists on the road. Please reconsider enforcing this unsafe and unfair legislation.

- The 416-A bill is unjust targeting a specific group, violating their freedom of choice. The penalties for violators are way to extreme and the bill is out of touch with motorcycle safety. The bill that should be proposed should be to raise the out dated EPA db. to better accomidate for a quickly growing and louder city.
