Uphold your Right to hold public Tribunal

We, the undersigned fellow citizens, are shocked to learn that Mr. Kirity Roy, a human rights defender, President of MASUM and State Director of the Project 'National Project on Preventing torture in India' in West Bengal, was falsely implicated and harassed by police for being the Secretary to a public tribunal, held under the auspicious of 'People's Tribunal on Torture'. The Kolkata Police, Detective Department lodged criminal case vide Taltolla Police Case no. 134 dated 9.6.2008 under sections 170/229/120B of Indian Penal Code.

Following the legacy of Russell-Sartre Tribunal and other numerous public tribunals held in India and across the globe, in quest of truth behind the occurrences of human rights violations of the people, is an act of exercising basic tenets of Universal Declaration of human rights as well as UN Declaration on Human Rights Defenders supported with national laws including fundamental rights guaranteed under Art.19/21 of the onstitution and also Art 51(c). It is also a fundamental duty of every citizen in India, to be inquisitive about public administration for spreading humanism as enshrined in Constitution of India under Art 51-A (h).

We urge upon you to put an end to any act of harassment, including at the judicial level, against Mr. Kirity Roy and other members of MASUM.

    • The police charges in this case are not only against Mr Kirity Roy and colleagues but against the entire notion of the right of people to organise and speak freely. People's tribunals are an internationally established practice and the police accusation that the persons concerned were somehow impersonating government officials goes beyond the point of being frivilous to the point of being an absurdity. Unfortunately, the case, and the manner in which the media were brought to record the harassment of a legitimate human rights organisation, is yet another example of India not as the world's biggest democracy but its biggest hypocrisy.
