Introduction

I, the Undersigned American Citizen hereby call upon my Representatives in the United States House and Senate to abolish the Feres Doctrine without further delay. I reasonably believe, the Feres Doctrine is a dangerous threat to the national security of the United States and the preservation of our Citizens human and constitutional rights serving in the United States Armed Forces for the following reasons;

Whereas, the Feres Doctrines exemption under the Federal Tort Claims Act (FTCA) of 1946, and its judicial grant of sovereign immunity violates the separation of powers, equal protection and due process clauses of the United States Constitution;

Whereas, the President of the United States and Congress are well aware of Americas veterans and families pleas for redress of human, and constitutional rights abuses arising incident to military service within the command, legal and medical systems of the DOD and military, serious public trust issues barred from redress under the Feres Doctrines exemption to the FTCA of 1946;

Whereas, the United States Supreme Court has continually placed the burden on Congress to remedy the Feres Doctrine injustice for the past 53 years. Congress has failed to act resulting in the following individual and systemic abuses arising in the DOD and military to go unremedied, to include, but not limited to:

(1), Murders, (2), Rapes, (3), human experimentation in violation of the Nuremberg Code, (Atomic Testing, LSD, Anthrax, other FDA unapproved inoculations), (4), Agent Orange and Gulf War Syndrome exposures and failure to treat, (5), Abuse of Power and Gross Negligent Acts, (6), Undue Command Influence, (7), Abuse and Double Standards under the Uniform Code of Military Justice (UCMJ), (7) Falsification of Official Documents, (8), Abuse of the militarys mental health system and administrative discharge process to retaliate against service members who expose corruption and to silence claims of fraud, waste and abuse, (9), service-connected mental or physical injury or injustice from being fully identified during medical review process resulting in years of emotional and financial hardships of honorably discharged Americans seeking just and equitable benefits within the VA health care system.

Whereas, the dangers of the Feres Doctrine has been presented to the United States Congress via: (1), The Rockefeller Senate VA Report of December 1994, recognizing the doctrine does allow uninformed consent human experimentations of Americans; (2), The Cox Commission Report on the 50th Anniversary of the UCMJ, recognizing non-legitimate military decision are violating the constitutional rights of Americans to redress wrongful acts and omission in the military command, legal and medical systems; (3), VERPAs Official Statement for the Record, re: October 8, 2002, Senate Judiciary Hearings on the Feres Doctrine, providing substantial claims from independent veteransorganizations and individuals asserting human and constitutional rights abuses with the DOD and VA.

Whereas, the public record clearly establishes the Feres Doctrine allows widespread corruption and abuse of power within the United States Armed Forces and prevents said corruption from reaching the public domain and is confirmed by the dissenting opinion of Supreme Court Justice Scalia who stated in Johnson v. United States (1987): Congresss inaction regarding this doctrine and its doing little, if anything in the way of modifying it to prevent Constitutional claims is clearly unjust and irrational. Again, allowing such power to military leaders can and does result in abuse therefore, where are the checks and balances on the military.

Conclusion

The VERPA Act of 2003, will provide the platform for all Veterans Organizations and Individual Advocates to educate the American Public of the widespread corruption within the DOD and VA. The testimony that will be provided will shock the nation and will: (1), restore the separation of powers, equal protection and due process clauses of the United States Constitution to afford American Citizens serving in the United States Armed Forces absolute protection to redress the wrongful acts and omissions of federal employees outside the scope of combat or acts that serve no legitimate military purpose, (2), ensure, American combat veterans and other service members injured "incident to military service" are afforded expeditious and equitable disability ratings and compensation prior to being released from active duty, and consistently monitored for life to upgrade disability related matters, (3), to establish a "zero tolerance mandate" to address and correct fraud, waste and abuse in the DOD/armed forces and VA; (4), to ensure existing federal laws to prosecute violators of American service members human and constitutional rights with tax payers monies rather than defending said violators, and for other purposes to ensure absolutely honor, integrity and accountability with the federal government.

The inherent dignity and equal protection of American Citizens inalienable human and constitutional rights serving in the United States Armed Forces must be absolute! The Feres Doctrine must be abolished!

    • The abolishment of this outdated and outlandish doctrine is both long overdue and will in no way effect the military, unless a crime has overtly been committed. As a 20+year veteran of the US ARMY it is both necessary and vital to ensure protection of our soldiers. As stated before, the abolishment of this this doctrine will in no way effect the good order and discipline in our military, only it will hold those accountable for their actions or inactions.

Since I found out about VERPA and the chilling affects of the Unconstitutional Fere's Doctrine that condon's human right's abuses within our military and Government I have been appaled by the fact that our own troops have been subjected to test's (Atomic Vets) and experimentation's to Gulf War Syndrom. Fifty years plus that we are aware of.There is no place in America for sovriegn ammunity or unaccountability for a person's actions while on this Earth. All should be held acountable for thier action's in public office. I have been honored to be voted as Chairman of VERPA . What gives our leaders the right to abuse their offices and their power by using the ferres doctrine as a sheild from accountability. Absolute power corrupts absolutely ! Too much waste of money, time and personnel is being perpetrated by those of higher rank. Human lives are being wasted by corrupt leaders on those below them who are reporting fraud, waste and corruption.     • The Feres Doctrine, along with the ongoing Rape of Patirotism at the hands of the U.S. Veterans Administration, along with the federal statute - - see: 28 USC 2860(h) - - which permits Uncle Sam to utilize "DECEIT" and "MISREPRESENTATION" against "We the People .. . " without fear of judicial intervention; along with our government presently permitting America's patriotic youngsters and their loved ones, to erroneously ASSUME without question, that they will have legal, enforceable and a contractual RIGHT to continuing long term VA medical care and/or disability compensation, concerning war injuries, when the awful truth of what the government will do to any veteran who dares sue it demanding such medical care, etc., is clearly revealed in the Levy v. Brown case before the U.S. Court of Veterans Appeals, when government attorneys asserted the following to the involved court: "VA benefits involve no agreement of the parties and may be redistributed or withdrawn at any time in the discretion of Congress."
