WE, THE UNDERSIGNED petition the Legislature and Governor Tim Pawlenty, of the State of Minnesota, to support and sign into law, legislation that requires a PRESUMPTION OF JOINT PHYSICAL CUSTODY in Minnesotas family law statutes.

We believe this law should expressly provide that joint physical custody is presumptively in the Best Interest of a Child except in cases involving abuse, endangerment or neglect, or where the parents otherwise agree.

    • The current laws need to be drastically updated! It's only fair for both parents to be a part of their children's life. Too many women, nowadays, are taking advantage of the current law, leaving too many fathers desperate to be a part of their children's life! Equality is the best interest for the child!!!

    • I think that the state should clearly recognize the importance of both parents in the lives of a child. In most cases, the child needs both of their parents to be an active member in their lives except for a few extreme cases where that may change, due to abuse or endangering that child.

    • Joint Custody has been shown over and over again to be in the best interest of children, anything less creates more problems for families than they will ever overcome.Kids have a right to both parents.Any thing other than joint custody is purely a ploy to garner money from the non-cust parent and the system.

    • No one would argue that the state has a right to invade an intact marriage to distribute parent time or money. Why then does the state have power over divorced parents? Because we give them that power when we submit to the court. Go back and read the Constitution. Stand on your rights as defined there. Your child deserves a family life free of conflict. Joint custody removes incentives for conflict and therefore will be the best for Mom, Dad, and the children. Only the lawyers will suffer a loss in income.
