We, Members of the Kenyan Community Abroad, hereby
petition the Interim Independent Constitutional Dispute
Resolution (IICDR) Court regarding the matter brought to the
Court by Mr Andrew Omtatah Okoiti, Prof Barrack Abonyo and
others, namely; Constitutional Petition No. 3 of 2010.
The Kenyan Community Abroad ( KCA ) has reviewed the
application by Andrew Omtatah Okoiti and others and noted
that it is seeking to stop the August 4th referendum for a
new constitution. In their petition No. 3 of 2010 which is
before the Interim Independent Constitutional Dispute
Resolution Court of Kenya ( IICDR ) , they are seeking the
Court`s direction , among other things, to :
1. Stop the referendum because of alleged contravention of
Sections 1, 1A, 3, 41A,47A & 60A of the Constitution of
Kenya
2. Direct the Interim Independent Electoral Commission of
Kenya to register Kenyans abroad as voters
The Kenyan Community Abroad (KCA ) is a registered nonprofit
organization in the State of Rhode Island. KCA has been at
the forefront of the fight for good governance, accountability
and the rule of law in Kenya since its inception in 1997.
While KCA would like Kenyans abroad to be registered as
voters, we believe that a new constitution is in the best
interest of Kenyans.
KCA and all Kenyans of goodwill, therefore, petition this
honourable Court to dismiss the application by Okoiti
et al and allow the referendum to go ahead as scheduled.

- As much as I'd like to be registered as a voter in the Aug 4th referrandum, the timing of this stoppage of the auspicious Aug 4th event is ill found. Time is of the essence and a realization of a new constituition is paramount -- Kenya and Kenyans is greater than any individual person. Lets vote YES, lets vote GREEN! - Postponing the constitution to allow for Kenyans abroad to vote will be prejudicial to the wider interests of Kenyans. This is a diversionary tactic by the forces opposed to the enactment of a new constitution. Omtatah and his group should be dismissed with the contempt that they deserve.
