Setting of a non political commission to review the existing reservation policy
It should be a non-political non-parliamentary commission with constitution, terms of reference and binding nature as described in the note attached.
Increase in number of seats
Number of seats should be increased in each institute/college such that numbers of general category seats are not decreased at any point, in that particular institute, by the present policy or any other policy in the future.
Till such time the total numbers of seats are increased, the reservation policy shall not be implemented and the academic year 2007 is not sacrosanct.
The increase in seats should lead to a proportionate increase in number of general category merit seats in each institution.
Number of seats in open merit should always remain at least 50.5\% exclusive of all the reservations and quotas including SC/ST, OBC, Defence personnel, physically handicapped etc.
Sequencing of the seats in each institution in each academic year should be done i.e. fill up of SC/ST first, then OBC, other reserved seats (if any) and thereafter general category seats.
Number of seats should not be increased until proper infrastructure is made in the colleges and adequate requirements met so that the quality does not suffer.
A technical committee comprising of members of the college itself should decide the possibility of increase in seats and if possible the amount of infrastructure and finances needed.
The reserved seats should be filled on the basis of "reasonable level of merit" which is defined as the students falling under the reserved seats should score at least 90 percent of marks scored by general category candidates in that particular entrance examination.
EXCLUSION OF CREAMY LAYER
Socio economic criteria to be set up and applied universally without any caste basis, which effectively excludes the affluent and those already having access to jobs and higher education.
A separate allocation of seats to be included in the proposed 27\% to students coming from weak and poorer background and who do not come in any other reservation categories.
No action of any nature should be taken against students, interns, doctors & others who participated in the agitation with regards to service break, termination, pay and leave deduction, legal action etc

Terms of Reference of the Expert Committee/Commission:-
Whether reservation and in particular reservation on caste basis is in the interest of the Country?
If answer to Question (1) is in the affirmative then and then only -
In what areas and fields the reservation policy can, if at all, with or without restrictions be implemented particularly in reference to reservation in specialized fields/areas etc. so that policy of reservation does not become oppressive on other sections of the Society?
Whether Mandal Commission report of 1980 requires reconsideration / review / modification / clarification etc. and in particular on account of the fact that the said Commission identified certain castes as backward etc. on the basis of a report of 1932 which is not relevant in the year 2006?
Whether the concept of economic backwardness and extension and denial of reservation to creamy layer irrespective of the caste and creed is an important criteria for the purposes of formulating and implementing reservation policy?
What should be the procedure, criteria and benchmark for grant or denial of reservation in specialized fields/area so that merit is not compromised?
Under what circumstances and when the benefit of reservation to a particular caste, creed and/or family would stand forfeited?
Whether the reservation can be made a permanent feature? If not, for how long can the reservation policy be continued.
Procedure to be followed by the Expert Committee/Commission:- In answering the above questions, the procedure that would be adopted by the Expert Committee/Commission should be spelt out in detail.
Binding nature of the report of the Expert Committee/Commission:-
It should be made clear that the report shall be compulsorily laid before both the Houses of the Parliament and discussed thoroughly within a reasonable time of the finalization of the report.
If the report of the Expert Committee/Commission differs from the report of the Mandal Commission or provides for a new basis for following the reservation policy than this report should prevail over the Mandal Commission report.

This petition says:
Quota/reservations has/have failed to achieve genuine equality, depriving us from the Fundamental Right to Equality.
Constitution and Reservation:
Where articles 15 and 16 ensure every citizen freedom and equality before law, the impractical provisions for reservation only highlight the contradictions in the machinery of the government.
Reservations were a part of the constitution when it was released in 1950. However, that was supposed to be a temporary measure and was to last for 10 years.
Part XVI of the Constitution makes certain reservations for the SC/ ST/ OBC for their election in the Legislative Assemblies and the House of People. Article 334 expressly provides that the reservations and special representations will cease after a period of fifty years.
An Amendment (79th amendment w.e.f. 25-1-2000) to the Constitution in 1999 extended this time frame of fifty years to sixty years. Is this justified?
Isn't this detrimental to the interests of the general members of the country who will now consider themselves unfortunate for not being tagged as "depressed" classes.
More than 50 years later the reservations continue to exist and have only become higher with passing years. The politicians, in an attempt to woo more votes from the public, continue to reserve more and more seats for SCs/ STs/ OBCs. This makes us feel as if the government covers its vested interests and political peripherals in the large cloak of democracy.
If vote banks are so important to our politicians then we assure them that they'd lose a considerable part of it. We will not stay unplugged.
Progeny of those who have got a position through quota should be denied the same privilege. One 'quota-case' in every family is sufficient.

- It's become extremely difficult for the GM (General Merit) candidates to obtain or get seats in educational institutions and to get a government job. Reservation or quota system has become the greatest bane of the post independent India in the 21st century. It's impossible for the most middle class GM candidates who do not get a seat in educational institutions in India to go to foreign countries to pursue higher studies, as it's too expensive. God save the GM candidates. In the mid '80s a GM candidate couldn't get an Engineering seat if his or her rank number is less than 2,500 out of a total number of 16,500 candidates who had appeared for CET, which was conducted for the first time in Karnataka. But a SC candidate could still get a seat despite getting a rank number of 13,500-14,000. Why's this discrimination? GM candidates have to consistently get very high merit just to get a seat in a particular branch and an institution of their choice.

- This unfortunately increases stress leading to strain, frustration, demoralisation, depression and suicidal tendencies among or amongst the Indian students or youth. For God's sake please discontinue the British or Britishers' policy of dividing and ruling India for short term and non-existent cheap electoral gains. I appeal to everyone concerned to stop the usage of politics to divide our beloved country India on the basis of caste or community or creed, gender or sex, language, quota or reservation, region or state and religion. Every Indian should enjoy the privileges of justice, liberty and EQUALITY. The recent bill on Reservation violates them all. The Karnataka governments Roster system of reservation in the state government jobs ensures that most jobs are given only to the reserved categories while the GM candidates get only miniscule or negligible representation.

- It is not that I'm against reservation. Reservation one such thing that uplift downtrodden and deprived community where they stand among other citizens. But in our country it has taken for political mileage. It is always creamy layer benefitting the reservations. I'm totally against the reservation policy where the merit is taken back seat.

- In Tamilnadu, 69\% reservation is there in institutions, medical council of India has identified 50 plus medical colleges in south India have fake doctors. Government can't just increase the seats, infrastructure for these institutes IIT's, IIM's and Medical colleges is in not so good shape today. Today, education in India has become a buying commodity. If Im not wrong, PG seat at reputed medical institutes take moolah up to 50 lakhs. After completion of graduation to whom the students has to serve.

- The Government must concentrate on providing fundamental education to all sections of people irrespective of cast or creed at the primary level. There are harfly any schools in rural areas which have sufficient number of dedicated teachers. Unless this is done, there is no use in 'reserving seats'. If this kind of idiotic thing is not stopped, a day may not be far away when even marks are 'reserved' for certain category of students!

- It is a well known fact that reservation has not helped in upliftment of the downtrodden people during the past 50 yrs. The government should setup an independent committee to inquire about other possibilities for upliftment of the really backward classes in the society. Blindly increasing the percentage of reservation in institutions of higher education is not going to serve any purpose.
