Support for Paintball markers and The Sports Authority in New York City

Regarding:

The citation of The Sports Authority Inc., for selling imitation semiautomatic machine guns under the auspices of the following;

NYC Administrative Law (Administrative Code of City of NY 10-131[g]; Proc of NYC Council, at 24 [Jan 18, 1955]), "Only toy guns that are not blue, black, silver or aluminum in color, bear an identifiable trade name or mark, and contain a solid plug in the barrel can be sold, possessed or used in New York City."


Petition:

We, the undersigned, realize that the products in question, sold by The Sports Authority and manufactured by Tippmann, Kingman and others are NOT toys, nor are they imitation guns. This being understood, we, the undersigned believe that the products in question do not fall under the above law.

We, the undersigned, realize that the products in question, are clearly marked "this is not a toy" and that the intended use of the markers are exclusively for participation in the sport of Paintball in a controlled, supervised environment. Safety is strongly emphasized by all manufacturers, organizers and participants.

We, the undersigned, wish to emphasize that the products in question, are in no way, designed or intended to be used in any other manner than their intended use in the sport of Paintball, a sport which now enjoys a popularity of over 7,600,000 participants annually in the U.S..

    • I fail to see the resemblance between a gun and a paintball marker... sure, they use similar principles in the way they fire... but the overall look of real guns are VASTLY differ from markers.

    • Hey all its me again, I don't think it is fair to punish the good players. I've been play for 4 years now going on 5 now. I play and own my own team Intensive Care. We are a 3 man team. As a refree on my free time I like to keep the good in the sport going. If we can get NY players the right the deserve to play. There are always the few who do give the sport a bad rep but for us who play and keep the masks on, barrel plugs in, and safetys on we should get some graditude. For the few who shots cares on gets a kid hurt cause they freeze there paintballs they get let off the hook usually. The proteams for dye, boblong, and shocktech teams who try to keep the sport alive and well. Yes there getting paid to go have fun but on there off time therse guys bust there butt to help the sport. Yes NY might have good reasons but if there let paintball in the state then if there is a problem punish that person more harshly. I have nothing else to say email me what you have to say about it I love to hear you commets.

    • Paintball is a very safe sport , Just like all other sports out there, there is a risk of injury, but for the people that follow the rules and play safe, the injury rate is relative low. I've been playing since 96 and the only injury I've encountered was a twist ankle from tripping from a bunker in the woods, but it is an adventure sport. If it is legal to play paintball in NYS, then they should at least let us play indoor paintball in the city.

    • This is the first I heard of this . After reading this I couldnt belive it. How is it that every other state in U.S. does not have this problem. I think that New York is going all about this the wrong way. As another person pointed out on this page, if you have a problem with people misusing there markers, Punish that person(s), not the rest of us.

    • Paintball markers are NOT toys, as clearly indicated by the manufactuers. Paintball markers do not come close resembling real semi-automatic weapons, there is no need for a ban. Placing a ban on paintball markers will only succeed in hurting the supporting companies of the sport.
