Seeking Justice for Stephen Pina

We respectfully ask that you carefully consider the following information. An objective view of this case will reveal that an innocent man is the subject of mistaken identity and has been wrongfully convicted.

On Friday, February 26, 1993 at approximately 8:45 p.m. two men were shot in Bostons Mission Hill Housing Projecthours later one died. Seven months passed and Stephen Pina learned that he was being accused of first-degree murder. Oddly though, Stephen was never blamed for shooting the surviving victim. This is peculiar since both were shot by the same perpetrator and with the same gun.

The police knew of four other suspects but neglected to investigate them. Coincidentally, the deceased victim had robbed two of those suspects earlier that day. Minutes after the robbery, the police asked if they wanted to press charges, one replied, F__ it, Ill take care of it myself later. Three hours later, the robber, Keith Robinson was murdered. Furthermore, it was verified that the other two suspects had previous possession of the homicidal weapon, however, they were never investigated nor considered as viable suspects.

In an affidavit, the surviving victim stated that Stephen was not the shooter and had not wounded him nor murdered the deceased victim. He also communicated to the police that they had the wrong man. Surprisingly, he was never used as a witness.

After three years and two trials, (the first trial ending in a hung jury after four days of deliberation and the second ending after six days of deliberations), Stephen was convicted of first-degree murder and sentenced to life in prison without parole.

We, the undersigned friends of Stephen Pina, believe that a grave miscarriage of justice has taken place. There is no solid, physical evidence connecting Stephen Pina with this crime, only the conflicting testimonies of drug addicts with criminal records.

One of these drug addicted witnesses told police that Stephen was wearing all black and that he got out of a car and argued with Keith Robinson, then went back to the car, retrieved a gun, walked back over to Keith and shot him.

Another drug addict told the police that there was no car and that Stephen came from a crowd of people wearing a red jacket, pulled the gun from inside his jacket and then shot the victim.

Furthermore, Stephens attorney was ineffective on the behalf of his decision not to use Stephens alibi witness. Nor did the defense attorney utilize the surviving victim as a witness to testify in Stephens defense. Clearly, here are two valuable witnesses who could have helped to avoid this horrible case of mistaken identity and would have testified that Stephen was not involved with this homicide.

This is a case riddled with reasonable doubt and many unanswered questions and should have never gone to trial. As Representatives of Massachusetts and the judicial system it is left to your judgment to take the steps within your authority to make sure justice is done and an innocent man is released from prison.

We appeal to you to prevent Stephen from spending another wrongful day in prison.
