2nd Amendment - ACLU to Recognize it as Equal |
To: American Civil Liberties Union"A well-regulated Militia being necessary to the security of a free State,
the right of the people to keep and bear Arms shall not be infringed."
The writer of this Petition, Rod C. Venger, does hereby ask that all American citizens read and electronically sign this petition to the American Civil Liberties Union (ACLU) to demand that it's organization give equal legal weight and attention to all amendments to the Constitution of the United Stated, regardless of it's position or agenda. This petition specifically addresses the ACLU's position on the Second Amendment.
The ACLU is most notably known for it's positions on the 1st, 5th and 14th Amendments to the Constitution and it's success in closing such cases at the highest levels of our judiciary. It's motto is, "Defending the Bill of Rights". A "button" on it's website states, "Keep America Safe and Free". We could not agree with those words more. We simply ask that the ACLU assist in a more equitable manner.
The ACLU's official policy on the Second Amendment to the Constitution states;
"The ACLU agrees with the Supreme Court's long-standing interpretation of the Second Amendment [as set forth in the 1939 case, U.S. v. Miller] that the individual's right to bear arms applies only to the preservation or efficiency of a well-regulated militia. Except for lawful police and military purposes, the possession of weapons by individuals is not constitutionally protected. Therefore, there is no constitutional impediment to the regulation of firearms." --Policy #47
The Petitioners disagree with this logic, noting that the ACLU has never been willing to simply rely on past precedent with respect to other civil liberties, but pushes the envelope into areas that society is often uncomfortable with. We have a difficult time believing that the ACLU would quietly tolerate any regulation of free speech for instance, or the regulation of voting rights. The law has evolved over time with respect to many of our rights and with the exception of the Second Amendment to the Constitution, the ACLU has evolved with time as well.
Our country has been beset by drugs, by crime, and now by terrorism. It is time for our Government, as well as the ACLU, to get off the fence and recognize that each person has the right to protect self and country, as well as engage in recreation, and that they must take the position that the tools to do so should be available as each individual feels the need. The words, "...the right of the people, to keep and bear arms, shall not be infringed" are not open to interpretation and indeed, the 5th Circuit Court of Appeals did state that gun ownership is an individual right. The rights of the people, as given to us by the Constitution, firstly in the form of the Bill of Rights, should not be looked upon as anachronistic, but rather as equal in all respects. This basic idea requires that each individual is treated equally by the ACLU and that it will put forth it's resources as merited, based on the needs of any case at hand, the needs of our society, and not on the agenda of the few. The ACLU must cease it's discriminatory practices.Sincerely,
